Amends the Pharmacy Practice Act. Provides that notwithstanding any general or special law to the contrary, a licensed pharmacist may dispense birth control in accordance with written, standardized procedures or protocols developed by the Department of Financial and Professional Regulation with the Department of Public Health and the Department of Human Services if the procedures or protocols are filed at the pharmacy before implementation and are available to the Department of Financial and Professional Regulation upon request. Requires a pharmacist to complete a training program approved by the Department of Human Services before dispensing birth control. Defines birth control.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Pharmacy Practice Act is amended by adding |
5 | | Section 19.3 as follows: |
6 | | (225 ILCS 85/19.3 new) |
7 | | Sec. 19.3. Dispensing birth control. |
8 | | (a) Notwithstanding any general or special law to the
|
9 | | contrary, a licensed pharmacist may dispense birth control
in |
10 | | accordance with written, standardized procedures or
protocols |
11 | | developed by the Department with the Department of
Public |
12 | | Health and the Department of Human Services if the
procedures |
13 | | or protocols are filed at the pharmacy before
implementation |
14 | | and are available to the Department upon
request. |
15 | | (b) Before dispensing birth control pursuant to this
|
16 | | Section, a pharmacist shall complete a training program
|
17 | | approved by the Department of Human Services. The training |
18 | | program shall include, but not be
limited to, proper |
19 | | documentation and quality assurance. |
20 | | (c) For the purpose of this Section, "birth control" means |
21 | | hormonal contraceptive patches and self-administered oral |
22 | | hormonal contraceptives.
