2 | AMENDMENT NO. ______. Amend Senate Bill 3462 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. References to Act. This Act may be referred to | ||||||
5 | as the Illinois Partners for Nutrient Loss Reduction Act. | ||||||
6 | Section 3. Findings. The General Assembly finds that: | ||||||
7 | (1) Excessive levels of nutrients are degrading the quality | ||||||
8 | of streams, rivers, and lakes within the State of Illinois and | ||||||
9 | contributing to the dead zone in the Gulf of Mexico. | ||||||
10 | (2) The State's Environmental Protection Agency and | ||||||
11 | Department of Agriculture collaborated with the Policy Working | ||||||
12 | Group, working with academics, environmental nonprofits, | ||||||
13 | representatives of federal, State, and local agencies, | ||||||
14 | wastewater treatment professionals, and the agricultural | ||||||
15 | community to develop the Illinois Nutrient Loss Reduction | ||||||
16 | Strategy in 2015. They continue to collaborate to implement the |

1 | Strategy. | ||||||
2 | (3) The Strategy sets a milestone to reduce nitrogen loads | ||||||
3 | in Illinois waters that leave the State by 15% and phosphorus | ||||||
4 | loads by 25% by 2025 from baseline levels of 1980-1996. One | ||||||
5 | goal is to reduce both nitrogen and phosphorus loads by 45%. | ||||||
6 | (4) The Environmental Protection Agency, the Department of | ||||||
7 | Natural Resources, and the Department of Agriculture require | ||||||
8 | resources to administer and implement the Strategy in order to | ||||||
9 | meet the Strategy's 2025 milestone and goal. | ||||||
10 | (5) Nutrient capture practices cost share grants will | ||||||
11 | assist Illinois' agricultural economy in meeting the goals of | ||||||
12 | the Strategy. | ||||||
13 | (6) Soil and Water Conservation Districts assist Illinois | ||||||
14 | farmers in implementing nutrient capture practices on their | ||||||
15 | farmland. | ||||||
16 | Section 5. The State Finance Act is amended by changing | ||||||
17 | Section 6z-32 as follows:

18 | (30 ILCS 105/6z-32)
| ||||||
19 | Sec. 6z-32. Partners for Planning and Conservation.
| ||||||
20 | (a) The Partners for Conservation Fund (formerly known as | ||||||
21 | the Conservation 2000 Fund) and the Partners for
Conservation | ||||||
22 | Projects Fund (formerly known as the Conservation 2000 Projects | ||||||
23 | Fund) are
created as special funds in the State Treasury. These | ||||||
24 | funds
shall be used to establish a comprehensive program to |

| |||||||
1 | protect Illinois' natural
resources through cooperative | ||||||
2 | partnerships between State government and public
and private | ||||||
3 | landowners. Moneys in these Funds may be
used, subject to | ||||||
4 | appropriation, by the Department of Natural Resources, | ||||||
5 | Environmental Protection Agency, and the
Department of | ||||||
6 | Agriculture for purposes relating to natural resource | ||||||
7 | protection,
planning, recreation, tourism, and compatible | ||||||
8 | agricultural and economic development
activities. Without | ||||||
9 | limiting these general purposes, moneys in these Funds may
be | ||||||
10 | used, subject to appropriation, for the following specific | ||||||
11 | purposes:
| ||||||
12 | (1) To foster sustainable agriculture practices and | ||||||
13 | control soil erosion ,
and sedimentation, and nutrient loss | ||||||
14 | from farmland, including grants to Soil and Water | ||||||
15 | Conservation Districts
for conservation practice | ||||||
16 | cost-share grants and for personnel, educational, and
| ||||||
17 | administrative expenses.
| ||||||
18 | (2) To establish and protect a system of ecosystems in | ||||||
19 | public and private
ownership through conservation | ||||||
20 | easements, incentives to public and private
landowners, | ||||||
21 | natural resource restoration and preservation, water | ||||||
22 | quality protection and improvement, land use and watershed | ||||||
23 | planning, technical assistance and grants, and
land | ||||||
24 | acquisition provided these mechanisms are all voluntary on | ||||||
25 | the part of the
landowner and do not involve the use of | ||||||
26 | eminent domain.

1 | (3) To develop a systematic and long-term program to | ||||||
2 | effectively measure
and monitor natural resources and | ||||||
3 | ecological conditions through investments in
technology | ||||||
4 | and involvement of scientific experts.
| ||||||
5 | (4) To initiate strategies to enhance, use, and | ||||||
6 | maintain Illinois' inland
lakes through education, | ||||||
7 | technical assistance, research, and financial
incentives.
| ||||||
8 | (5) To partner with private landowners and with units | ||||||
9 | of State, federal, and local government and with | ||||||
10 | not-for-profit organizations in order to integrate State | ||||||
11 | and federal programs with Illinois' natural resource | ||||||
12 | protection and restoration efforts and to meet | ||||||
13 | requirements to obtain federal and other funds for | ||||||
14 | conservation or protection of natural resources. | ||||||
15 | (6) To implement the State's Nutrient Loss Reduction | ||||||
16 | Strategy, including, but not limited to, funding the | ||||||
17 | resources needed to support the Strategy's Policy Working | ||||||
18 | Group, cover water quality monitoring in support of | ||||||
19 | Strategy implementation, prepare a biennial report on the | ||||||
20 | progress made on the Strategy every 2 years, and provide | ||||||
21 | cost share funding for nutrient capture projects.
| ||||||
22 | (b) The State Comptroller and State Treasurer shall | ||||||
23 | automatically transfer
on the last day of each month, beginning | ||||||
24 | on September 30, 1995 and ending on
June 30, 2026 2021 ,
from | ||||||
25 | the General Revenue Fund to the Partners for Conservation
Fund,
| ||||||
26 | an
amount equal to 1/10 of the amount set forth below in fiscal |
| ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
| ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||

25 | (c) Notwithstanding any other provision of law to the | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
26 | contrary and in addition to any other transfers that may be |

| |||||||
1 | provided for by law, on the last day of each month beginning on | ||||||
2 | July 31, 2006 and ending on June 30, 2007, or as soon | ||||||
3 | thereafter as may be practical, the State Comptroller shall | ||||||
4 | direct and the State Treasurer shall transfer $1,000,000 from | ||||||
5 | the Open Space Lands Acquisition and Development Fund to the | ||||||
6 | Partners for Conservation Fund (formerly known as the | ||||||
7 | Conservation 2000 Fund).
| ||||||
8 | (d) There shall be deposited into the Partners for
| ||||||
9 | Conservation Projects Fund such
bond proceeds and other moneys | ||||||
10 | as may, from time to time, be provided by law.
| ||||||
11 | (e) For years 2021 through 2026, $1,075,000 from the | ||||||
12 | Partners for Conservation Fund shall be provided annually to | ||||||
13 | the Agency and used as follows: | ||||||
14 | (1) $530,000 for coordination of Strategy | ||||||
15 | implementation, including, but not limited to, meeting | ||||||
16 | coordination, reporting, and watershed coordination; and | ||||||
17 | (2) $545,000 to cover water quality monitoring in | ||||||
18 | support of Strategy implementation. | ||||||
19 | (f) For years 2021 through 2026, funding from the Partners | ||||||
20 | for Conservation Fund shall be provided annually to the | ||||||
21 | Department of Agriculture: | ||||||
22 | (1) to be used for Soil and Water Conservation | ||||||
23 | Districts for personnel, educational, and administrative | ||||||
24 | expenses; | ||||||
25 | (2) to fund the Cover Crops Insurance Premium Discount | ||||||
26 | Program; and |
| ||||||||||||||||||||||||||||||
| ||||||||||||||||||||||||||||||
1 | (3) for conservation practices cost share grants and | |||||||||||||||||||||||||||||
2 | technical assistance. | |||||||||||||||||||||||||||||
3 | Funding provided to the Department of Agriculture under | |||||||||||||||||||||||||||||
4 | this subsection shall be in the amount set forth below in each | |||||||||||||||||||||||||||||
5 | of the specified fiscal years: | |||||||||||||||||||||||||||||

13 | (g) For years 2021 through 2026, $7,000,000 funding from | |||||||||||||||||||||||||||||
14 | the Partners for Conservation Fund shall be provided annually | |||||||||||||||||||||||||||||
15 | to the Department of Natural Resources and used as follows: | |||||||||||||||||||||||||||||
16 | (1) $6,000,000 for personnel, educational, | |||||||||||||||||||||||||||||
17 | administrative, and conservation practices expenses; and | |||||||||||||||||||||||||||||
18 | (2) $1,000,000 for conservation practices on publicly | |||||||||||||||||||||||||||||
19 | owned property of the Department of Natural Resources, and | |||||||||||||||||||||||||||||
20 | its surrounding area, that is leased to agricultural | |||||||||||||||||||||||||||||
21 | producers. | |||||||||||||||||||||||||||||
22 | In this Section, "strategy" means the 2015 Illinois | |||||||||||||||||||||||||||||
23 | Nutrient Loss Reduction Strategy document and its biennial | |||||||||||||||||||||||||||||
24 | reports of 2017 and 2019. | |||||||||||||||||||||||||||||

1 | Section 99. Effective date. This Act takes effect upon | ||||||
2 | becoming law.".
