AMENDMENT TO SENATE BILL 3408

2    AMENDMENT NO. ______. Amend Senate Bill 3408 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Abraham Lincoln Presidential Library and
5Museum Act is amended by changing Sections 30, 35, and 45 and
6by adding Section 3 as follows:
 
7    (20 ILCS 3475/3 new)
8    Sec. 3. Executive Order superseded. Executive Order No.
92017-1 created the Abraham Lincoln Presidential Library and
10Museum as a State agency under the jurisdiction of the
11Governor. This Act is the implementation of that Executive
12Order. To the extent that there is a conflict between the
13provisions of the Executive Order and this Act, this Act
14supersedes the Executive Order, and shall be controlling.

1    Sec. 30. Administration of the Agency. The Agency shall be
2under the supervision and direction of an Executive Director.
3The person serving on the effective date of this Act as Library
4Director, as defined in Section 33 of the Historic Preservation
5Act, shall become the inaugural Executive Director on the
6effective date of this Act and shall serve as Executive
7Director until the expiration of his then-current term as
8Library Director. Thereafter, the Board shall appoint the
9Executive Director with the advice and consent of the Senate.
10The Executive Director shall serve at the pleasure of the Board
11for a term of 4 years. The Executive Director shall, subject to
12applicable provisions of law, execute and discharge the powers
13and duties of the Agency. The Executive Director shall have
14hiring power and shall appoint (a) a Facilities Services
15Library Facilities Operations Director; and (b) a Director of
16the Library Services Director. The Executive Director shall
17appoint those other employees of the Agency as he or she deems
18appropriate and shall fix the compensation of the Facilities
19Services Library Facilities Operations Director, the Director
20of the Library Services Director, and other employees. The
21Executive Director may make provision to establish and collect
22admission and registration fees, operate a gift shop, and
23publish and sell educational and informational materials.

1    Sec. 35. State Historian; exchange historical records. The
2State Historian shall make all necessary rules, regulations,
3and bylaws not inconsistent with law to carry into effect the
4purposes of this Act and to procure from time to time as may be
5possible and practicable, at reasonable costs, all books,
6pamphlets, manuscripts, monographs, writings, and other
7material of historical interest and useful to the historian
8bearing upon the political, physical, religious, or social
9history of the State of Illinois from the earliest known period
10of time. The State Historian may, with the consent of the
11Executive Director Board, exchange any books, pamphlets,
12manuscripts, records, or other materials which such library may
13acquire that are of no historical interest or for any reason
14are of no value to it, with any other library, school or
15historical society. The State Historian shall distribute
16volumes of the series known as the Illinois Historical
17Collections now in print, and to be printed, to all who may
18apply for same and who pay to the Library and Museum for such
19volumes an amount fixed by the State Historian sufficient to
20cover the expenses of printing and distribution of each volume
21received by such applicants. However, the State Historian shall
22have authority to furnish 25 of each of the volumes of the
23Illinois Historical Collections, free of charge, to each of the
24authors and editors of the Collections or parts thereof; to
25furnish, as in his or her discretion he or she deems necessary
26or desirable, a reasonable number of each of the volumes of the

1Collections without charge to archives, libraries, and similar
2institutions from which material has been drawn or assistance
3has been given in the preparation of such Collections, and to
4the officials thereof; and to furnish, as in his or her
5discretion he or she deems necessary or desirable, a reasonable
6number of each of the volumes of the Collections without charge
7to the University of Illinois Library and to instructors and
8officials of that University, and to public libraries in the
9State of Illinois. The State Historian may, with the consent of
10the Board, also make exchanges of the Historical Collections
11with any other library, school or historical society, and
12distribute volumes of the Collections for review purposes.

15    Sec. 45. State Historian; historical records. The State
16Historian shall establish and supervise a program within the
17Agency designed to preserve as historical records selected past
18editions of newspapers of this State. Such editions and other
19materials shall be preserved in accordance with industry
20standards and shall be stored in a place provided by the
21Agency. The negatives of microphotographs and other materials
22shall be stored in a place provided by the Agency.
23    The State Historian shall determine on the basis of
24historical value the various newspaper edition files which
25shall be preserved and shall arrange a schedule for such

1preservation. The State Historian or his or her designee shall
2work with library personnel in shall supervise the making of
3arrangements for acquiring access to past edition files and
4copyright permissions with the editors or publishers of the
5various newspapers.
6    The method of microphotography to be employed in this
7program shall conform to the standards established pursuant to
8Section 17 of the State Records Act.
9    Upon payment to the Agency of the required fee, any person
10or organization shall be granted access to the preserved
11editions of newspapers and all records supplied with any prints
12requested to be made from the newspapers and all records. The
13fee required shall be determined by the State Historian and
14shall be equal in amount to the costs incurred by the Agency in
15granting such access supplying the requested prints.
