Amends the Local Food, Farms, and Jobs Act. Provides that the State (rather than the Local Food, Farms, and Jobs Council) shall support and encourage that 10% of food and food products purchased by entities funded in part or in whole by State dollars be local farm or food products. Provides that all State agencies and State-owned facilities that purchase food and food products shall publish on their applicable procurement bulletin their farm or food purchases for the recently completed fiscal year. Provides that the first published report shall be due no later than January 1, 2021 and represent fiscal year 2020 purchases. Provides that a report shall be due each January 1 thereafter and be published on a form prescribed by each applicable Chief Procurement Officer. Removes provisions concerning the creation, responsibilities, and governance of the Local Food, Farms, and Jobs Council. Amends the Commission to End Hunger Act to make a conforming change concerning the Local Food, Farms, and Jobs Council. Makes other changes. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Commission to End Hunger Act is amended by |
5 | | changing Section 15 as follows: |
6 | | (20 ILCS 5015/15)
|
7 | | Sec. 15. Members. The Commission to End Hunger shall be |
8 | | composed of no more than 21 voting members including 2 members |
9 | | of the Illinois House of Representatives, one appointed by the |
10 | | Speaker of the House and one appointed by the House Minority |
11 | | Leader; 2 members of the Illinois Senate, one appointed by the |
12 | | Senate President and one appointed by the Senate Minority |
13 | | Leader; one representative of the Office of the Governor |
14 | | appointed by the Governor; one representative of the Office of |
15 | | the Lieutenant Governor appointed by the Lieutenant Governor; |
16 | | and 15 public members, who shall be appointed by the Governor.

17 | | The public members shall include 2 representatives of food |
18 | | banks; 2 representatives from other community food assistance |
19 | | programs; a representative of a statewide organization focused |
20 | | on responding to hunger; a representative from an anti-poverty |
21 | | organization; a representative of an organization that serves |
22 | | or advocates for children and youth; a representative of an |
23 | | organization that serves or advocates for older adults; a |

1 | | representative of an organization that advocates for people who |
2 | | are homeless; a representative of an organization that serves |
3 | | or advocates for persons with disabilities; a representative of |
4 | | an organization that advocates for immigrants; a |
5 | | representative of a municipal or county government; and 3 |
6 | | at-large members. The appointed members shall reflect the |
7 | | racial, gender, and geographic diversity of the State and shall |
8 | | include representation from regions of the State. |
9 | | The following officials shall serve as ex-officio members: |
10 | | the Secretary of Human Services or his or her designee; the |
11 | | State Superintendent of Education or his or her designee; the |
12 | | Director of Healthcare and Family Services or his or her |
13 | | designee; the Director of Children and Family Services or his |
14 | | or her designee; the Director of Aging or his or her designee; |
15 | | the Director of Natural Resources or his or her designee; and |
16 | | the Director of Agriculture or his or her designee. The |
17 | | African-American Family Commission and , the Latino Family |
18 | | Commission , and the Local Food, Farms, and Jobs Council shall |
19 | | each designate a liaison to serve ex-officio on the Commission.

20 | | Members shall serve without compensation and are |
21 | | responsible for the cost of all reasonable and necessary travel |
22 | | expenses connected to Commission business, as the State of |
23 | | Illinois will not reimburse Commission members for these costs.
|
24 | | Commission members shall be appointed within 60 days after |
25 | | the effective date of this Act. The Commission shall hold their |
26 | | initial meetings within 60 days after at least 50% of the |

1 | | members have been appointed.
|
2 | | The representative of the Office of the Governor and a |
3 | | representative of a food bank shall serve as co-chairs of the |
4 | | Commission.
|
5 | | At the first meeting of the Commission, the members shall |
6 | | select a 5-person Steering Committee that includes the |
7 | | co-chairs.
|
8 | | The Commission may establish committees that address |
9 | | specific issues or populations and may appoint individuals with |
10 | | relevant expertise who are not appointed members of the |
11 | | Commission to serve on committees as needed. |
12 | | The Office of the Governor, or a designee of the Governor's |
13 | | choosing, shall provide guidance to the Commission. Under the |
14 | | leadership of the Office of the Governor, subject to |
15 | | appropriation, the Department of Human Services shall also |
16 | | provide leadership to support the Commission. The Department of |
17 | | Human Services and the State of Illinois shall not incur any |
18 | | costs as a result of the creation of the Commission to End |
19 | | Hunger as the coordination of meetings, report preparation, and |
20 | | other related duties will be completed by a representative of a |
21 | | food bank that is serving as a co-chair of the Commission.

23 | | Section 10. The Local Food, Farms, and Jobs Act is amended |
24 | | by changing Section 10 as follows: |

2 | | Sec. 10. Procurement goals for local farm or food products. |
3 | | (a) In order to create, strengthen, and expand local farm |
4 | | and food economies throughout Illinois, it shall be the goal of |
5 | | this State that 20% of all food and food products purchased by |
6 | | State agencies and State-owned facilities, including, without |
7 | | limitation, facilities for persons with mental health and |
8 | | developmental disabilities, correctional facilities, and |
9 | | public universities, shall, by 2020, be local farm or food |
10 | | products.
|
11 | | (b) The State Local Food, Farms, and Jobs Council |
12 | | established under this Act shall support and encourage that 10% |
13 | | of food and food products purchased by entities funded in part |
14 | | or in whole by State dollars, which spend more than $25,000 per |
15 | | year on food or food products for its students, residents, or |
16 | | clients, including, without limitation, public schools, child |
17 | | care facilities, after-school programs, and hospitals, shall, |
18 | | by 2020, be local farm or food products.

19 | | (c) To meet the goals set forth in this Section, when a |
20 | | State contract for purchase of food or food products is to be |
21 | | awarded to the lowest responsible bidder, an otherwise |
22 | | qualified bidder who will fulfill the contract through the use |
23 | | of local farm or food products may be given preference over |
24 | | other bidders, provided that the cost included in the bid of |
25 | | local farm or food products is not more than 10% greater than |
26 | | the cost included in a bid that is not for local farm or food |

2 | | (d) All State agencies and State-owned facilities that |
3 | | purchase food and food products shall , with the assistance of |
4 | | the Local Food, Farms, and Jobs Council, develop a system for |
5 | | (i) identifying the percentage of local farm or food products |
6 | | purchased for fiscal year 2019 2011 as the baseline; and (ii) |
7 | | tracking and reporting local farm or food products purchases on |
8 | | an annual basis.

9 | | (e) All State agencies and State-owned facilities that |
10 | | purchase food and food products shall publish on their |
11 | | applicable procurement bulletin their farm or food purchases |
12 | | for the recently completed fiscal year. The first published |
13 | | report shall be due no later than January 1, 2021 and represent |
14 | | fiscal year 2020 purchases. A report shall be due each January |
15 | | 1 thereafter and be published on a form prescribed by each |
16 | | applicable Chief Procurement Officer. |

22 | | by repealing Sections 15, 20, and 25.

23 | | Section 99. Effective date. This Act takes effect upon |
24 | | becoming law.
