SYNOPSIS AS INTRODUCED:

    Amends the Local Food, Farms, and Jobs Act. Provides that the State (rather than the Local Food, Farms, and Jobs Council) shall support and encourage that 10% of food and food products purchased by entities funded in part or in whole by State dollars be local farm or food products. Provides that all State agencies and State-owned facilities that purchase food and food products shall publish on their applicable procurement bulletin their farm or food purchases for the recently completed fiscal year. Provides that the first published report shall be due no later than January 1, 2021 and represent fiscal year 2020 purchases. Provides that a report shall be due each January 1 thereafter and be published on a form prescribed by each applicable Chief Procurement Officer. Removes provisions concerning the creation, responsibilities, and governance of the Local Food, Farms, and Jobs Council. Amends the Commission to End Hunger Act to make a conforming change concerning the Local Food, Farms, and Jobs Council. Makes other changes. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Commission to End Hunger Act is amended by
5changing Section 15 as follows:
 
6    (20 ILCS 5015/15)
7    Sec. 15. Members. The Commission to End Hunger shall be
8composed of no more than 21 voting members including 2 members
9of the Illinois House of Representatives, one appointed by the
10Speaker of the House and one appointed by the House Minority
11Leader; 2 members of the Illinois Senate, one appointed by the
12Senate President and one appointed by the Senate Minority
13Leader; one representative of the Office of the Governor
14appointed by the Governor; one representative of the Office of
15the Lieutenant Governor appointed by the Lieutenant Governor;
16and 15 public members, who shall be appointed by the Governor.
17    The public members shall include 2 representatives of food
18banks; 2 representatives from other community food assistance
19programs; a representative of a statewide organization focused
20on responding to hunger; a representative from an anti-poverty
21organization; a representative of an organization that serves
22or advocates for children and youth; a representative of an
23organization that serves or advocates for older adults; a

1representative of an organization that advocates for people who
2are homeless; a representative of an organization that serves
3or advocates for persons with disabilities; a representative of
4an organization that advocates for immigrants; a
5representative of a municipal or county government; and 3
6at-large members. The appointed members shall reflect the
7racial, gender, and geographic diversity of the State and shall
8include representation from regions of the State.
9    The following officials shall serve as ex-officio members:
10the Secretary of Human Services or his or her designee; the
11State Superintendent of Education or his or her designee; the
12Director of Healthcare and Family Services or his or her
13designee; the Director of Children and Family Services or his
14or her designee; the Director of Aging or his or her designee;
15the Director of Natural Resources or his or her designee; and
16the Director of Agriculture or his or her designee. The
17African-American Family Commission and , the Latino Family
18Commission, and the Local Food, Farms, and Jobs Council shall
19each designate a liaison to serve ex-officio on the Commission.
20    Members shall serve without compensation and are
21responsible for the cost of all reasonable and necessary travel
22expenses connected to Commission business, as the State of
23Illinois will not reimburse Commission members for these costs.
24    Commission members shall be appointed within 60 days after
25the effective date of this Act. The Commission shall hold their
26initial meetings within 60 days after at least 50% of the

1members have been appointed.
2    The representative of the Office of the Governor and a
3representative of a food bank shall serve as co-chairs of the
4Commission.
5    At the first meeting of the Commission, the members shall
6select a 5-person Steering Committee that includes the
7co-chairs.
8    The Commission may establish committees that address
9specific issues or populations and may appoint individuals with
10relevant expertise who are not appointed members of the
11Commission to serve on committees as needed.
12    The Office of the Governor, or a designee of the Governor's
13choosing, shall provide guidance to the Commission. Under the
14leadership of the Office of the Governor, subject to
15appropriation, the Department of Human Services shall also
16provide leadership to support the Commission. The Department of
17Human Services and the State of Illinois shall not incur any
18costs as a result of the creation of the Commission to End
19Hunger as the coordination of meetings, report preparation, and
20other related duties will be completed by a representative of a
21food bank that is serving as a co-chair of the Commission.

23    Section 10. The Local Food, Farms, and Jobs Act is amended
24by changing Section 10 as follows:

2    Sec. 10. Procurement goals for local farm or food products.
3    (a) In order to create, strengthen, and expand local farm
4and food economies throughout Illinois, it shall be the goal of
5this State that 20% of all food and food products purchased by
6State agencies and State-owned facilities, including, without
7limitation, facilities for persons with mental health and
8developmental disabilities, correctional facilities, and
9public universities, shall, by 2020, be local farm or food
10products.
11    (b) The State Local Food, Farms, and Jobs Council
12established under this Act shall support and encourage that 10%
13of food and food products purchased by entities funded in part
14or in whole by State dollars, which spend more than $25,000 per
15year on food or food products for its students, residents, or
16clients, including, without limitation, public schools, child
17care facilities, after-school programs, and hospitals, shall,
18by 2020, be local farm or food products.
19    (c) To meet the goals set forth in this Section, when a
20State contract for purchase of food or food products is to be
21awarded to the lowest responsible bidder, an otherwise
22qualified bidder who will fulfill the contract through the use
23of local farm or food products may be given preference over
24other bidders, provided that the cost included in the bid of
25local farm or food products is not more than 10% greater than
26the cost included in a bid that is not for local farm or food

1products.
2    (d) All State agencies and State-owned facilities that
3purchase food and food products shall, with the assistance of
4the Local Food, Farms, and Jobs Council, develop a system for
5(i) identifying the percentage of local farm or food products
6purchased for fiscal year 2019 2011 as the baseline; and (ii)
7tracking and reporting local farm or food products purchases on
8an annual basis.
9    (e) All State agencies and State-owned facilities that
10purchase food and food products shall publish on their
11applicable procurement bulletin their farm or food purchases
12for the recently completed fiscal year. The first published
13report shall be due no later than January 1, 2021 and represent
14fiscal year 2020 purchases. A report shall be due each January
151 thereafter and be published on a form prescribed by each
16applicable Chief Procurement Officer.

21    Section 15. The Local Food, Farms, and Jobs Act is amended
22by repealing Sections 15, 20, and 25.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
