Amends the Illinois Municipal Code. Provides that a municipality, plan commission, or planning department may not adopt or enforce an ordinance, a zoning map, an official comprehensive plan, an official map, or any other regulation that discriminates against manufactured homes or modular homes solely because those homes are manufactured homes or modular homes. Limits home rule powers.

1 | | AN ACT concerning local government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Sections 11-12-6.5 and 11-13-28 as follows: |
6 | | (65 ILCS 5/11-12-6.5 new) |
7 | | Sec. 11-12-6.5. Manufactured home and modular home |
8 | | regulation. Notwithstanding any other provision of law, a |
9 | | municipality, plan commission, or planning department may not |
10 | | adopt or enforce an official comprehensive plan, official map, |
11 | | or any other regulation under this Division that discriminates |
12 | | against manufactured homes or modular homes solely because |
13 | | those homes are manufactured homes or modular homes. |
14 | | A home rule municipality may not regulate manufactured |
15 | | homes or modular homes in a manner inconsistent with this |
16 | | Section. This Section is a limitation under subsection (i) of |
17 | | Section 6 of Article VII of the Illinois Constitution on the |
18 | | concurrent exercise by home rule units of powers and functions |
19 | | exercised by the State. |
