AMENDMENT TO SENATE BILL 3277

2    AMENDMENT NO. ______. Amend Senate Bill 3277 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Pension Code is amended by
5changing Section 8-165 and by adding Sections 8-180.3 and
68-180.4 as follows:
 
7    (40 ILCS 5/8-165)  (from Ch. 108 1/2, par. 8-165)
8    Sec. 8-165. Re-entry into service.
9    (a) Except as provided in subsection (c), when When an
10employee receiving age and service or prior service annuity who
11has withdrawn from service after the effective date re-enters
12service before age 65, any annuity previously granted and any
13annuity fixed for his wife shall be cancelled. The employee
14shall be credited for annuity purposes with sums sufficient to
15provide annuities equal to those cancelled, as of their ages on
16the date of re-entry; provided, the maximum age of the wife for

1this purpose shall be as provided in Section 8-155 of this
2Article.
3    The sums so credited shall provide for annuities to be
4fixed and granted in the future. Contributions by the employees
5and the city for the purposes of this Article shall be made,
6and when the proper time arrives, as provided in this Article,
7new annuities based upon the total credit for annuity purposes
8and the entire term of his service shall be fixed for the
9employee and his wife.
10    If the employee's wife died before he re-entered service,
11no part of any credits for widow's or widow's prior service
12annuity at the time annuity for his wife was fixed shall be
13credited upon re-entry into service, and no such sums shall
14thereafter be used to provide such annuity.
15    (b) Except as provided in subsection (c), when When an
16employee re-enters service after age 65, payments on account of
17any annuity previously granted shall be suspended during the
18time thereafter that he is in service, and when he again
19withdraws, annuity payments shall be resumed. If the employee
20dies in service, his widow shall receive the amount of annuity
21previously fixed for her.
22    (c) For school years beginning on or after July 1, 2020, an
23age and service or prior service annuity shall not be cancelled
24in the case of an employee who is re-employed by the Board of
25Education of the city as a Special Education Classroom
26Assistant or Classroom Assistant on a temporary and non-annual

1basis or on an hourly basis so long as the person: (1) does not
2work for compensation on more than 120 days in a school year;
3or (2) does not accept gross compensation for the re-employment
4in a school year in excess of $30,000. Re-employment under this
5subsection does not require contributions, result in service
6credit being earned or granted, or constitute active
7participation in the Fund.

9    (40 ILCS 5/8-180.3 new)
10    Sec. 8-180.3. Credit for service as a part-time employee of
11the Board of Education of the city. An employee of the Board of
12Education of the city, regardless of his or her position, may
13establish service credit in the Fund for part-time employment
14with the Board of Education of the city prior to becoming an
15employee by applying no later than one year after the effective
16date of this amendatory Act of the 101st General Assembly and
17paying to the Fund for that employment an amount equal to: (1)
18employee contributions based on the actual compensation
19received and the rate of contribution in effect on the date of
20payment; plus (2) an amount representing employer
21contributions equal to the amount specified in item (1); plus
22(3) interest thereon at the rate of 6% per annum, compounded
23annually, from the date of service to the date of payment.
24However, service credit shall not be granted under this Section
25for any such prior employment for which the applicant received

1credit under any other provision of this Code or during which
2the applicant was on a leave of absence.
 
3    (40 ILCS 5/8-180.4 new)
4    Sec. 8-180.4. Credit for service as an employee of the
5Metropolitan Pier and Exposition Authority. An employee of the
6Board of Education of the city, regardless of his or her
7position, may establish service credit in the Fund for
8employment with the Metropolitan Pier and Exposition Authority
9prior to becoming an employee by applying no later than one
10year after the effective date of this amendatory Act of the
11101st General Assembly and paying to the Fund for that
12employment an amount equal to: (1) employee contributions based
13on the actual compensation received and the rate of
14contribution in effect on the date of payment; plus (2) an
15amount representing employer contributions equal to the amount
16specified in item (1); plus (3) interest thereon at the rate of
176% per annum, compounded annually, from the date of service to
18the date of payment. However, service credit shall not be
19granted under this Section for any such prior employment for
20which the applicant received credit under any other provision
21of this Code or during which the applicant was on a leave of
22absence.
 
23    Section 99. Effective date. This Act takes effect July 1,
242020.".
