4 | | "Section 5. The Illinois Vehicle Code is amended by |
5 | | changing Section 6-105 as follows:

7 | | Sec. 6-105.
Instruction permits and temporary licenses
for |
8 | | persons 18 years of age or older.
|
9 | | (a) Except as provided in this Section, the Secretary of |
10 | | State upon
receiving proper application and payment of the |
11 | | required fee may issue an
instruction permit to any person 18 |
12 | | years of age or older
who is not ineligible for a license under
|
13 | | paragraphs 1, 3, 4, 5, 7, or 8 of Section 6-103, after the |
14 | | applicant has
successfully passed such examination as the |
15 | | Secretary of State in his
discretion may prescribe.

16 | | 1. An instruction permit entitles the holder while having |
|

1 | | the permit in
his immediate possession to drive a motor |
2 | | vehicle, excluding a motor driven
cycle or motorcycle, upon the |
3 | | highways for a period of 12 months after the
date of its |
4 | | issuance when accompanied by a licensed driver
who is 21 years |
5 | | of age or older, who has had a
valid driver's license |
6 | | classification to operate such vehicle for at least
one year |
7 | | and has had one year of driving experience
with such |
8 | | classification and who is occupying a seat beside the
driver.

9 | | 2. A 12 month instruction permit for a motor driven cycle |
10 | | or motorcycle
may be issued
to a person 18 years of age or |
11 | | more, and entitles the holder to
drive upon the highways during |
12 | | daylight under the direct supervision of a
licensed
motor |
13 | | driven cycle operator or motorcycle operator
with the same or

14 | | greater classification, who is 21 years of age or older and who |
15 | | has at least
one year of driving experience.
|
16 | | 3. (Blank).

17 | | (b) (Blank).
|
18 | | (c) The Secretary of State may issue a temporary
driver's |
19 | | license to an applicant for a license permitting the operation
|
20 | | of a motor vehicle while the Secretary is completing
an |
21 | | investigation and determination of all facts relative to
such |
22 | | applicant's eligibility to receive such license, or for any |
23 | | other
reason prescribed by rule or regulation promulgated by |
24 | | the Secretary of
State. Such permit must be in the applicant's |
25 | | immediate possession
while operating a motor vehicle, and it |
26 | | shall be invalid when the applicant's
driver's license has been |

1 | | issued or for good cause has been refused.
In each case the |
2 | | Secretary of State may issue the temporary driver's
license for |
3 | | such period as appropriate but in no
event for longer than 90 |
4 | | days. The Secretary may issue such additional temporary |
5 | | driver's licenses to an applicant as are necessary to allow the |
6 | | applicant to drive during the pendency of the investigation, |
7 | | valid for such a period as is appropriate, but in no event for |
8 | | longer than 90 days each.

10 | | Section 99. Effective date. This Act takes effect upon |
