SYNOPSIS AS INTRODUCED:
 
410 ILCS 510/5 new

    Amends the Cadaver Act. Creates the Cadaver Advisory Council and tasks it with creating and maintaining a document containing current embalming techniques, preservation practices, and air quality testing from universities within the State, as well as recommendations regarding the administration of an anatomical education program. Requires the document to be made available on the Department of Public Health's website and kept up to date by the Department as it is maintained by the Council. Provides that the Council shall meet at least every 6 months. Provides that the Director of Public Health shall serve as the Council's chairperson alongside other specified members, who shall serve without compensation but may be reimbursed for reasonable and necessary expenses from funds appropriated to the Department for that purpose. Provides specified responsibilities for the chairperson, in consultation with Council members. Effective July 1, 2020.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cadaver Act is amended by adding Section 5
5as follows:
 
6    (410 ILCS 510/5 new)
7    Sec. 5. Cadaver Advisory Council.
8    (a) The General Assembly finds that:
9        (1) Embalming practices for medical education are not
10    standardized or monitored in the United States. Labs
11    throughout the nation use a variety of embalming solutions
12    that may contain formaldehyde, phenol, MEA, or other
13    chemicals. These chemicals may be influenced by
14    temperature and regional environments, and universities
15    cannot guarantee that the bodies students are learning from
16    have been embalmed using the safest, most efficient
17    processes. This could potentially create a dangerous
18    situation for both students and educators in cadaver labs
19    throughout the State.
20        (2) Therefore, it would be beneficial to both students
21    and educators, and to all of the universities and colleges
22    in the State, if there was created an organized group of
23    experts to meet and discuss anatomical laboratory

1    education safety and the safe use, transportation, and
2    storage of cadavers used for anatomical education
3    programs.
4    (b) In this Section:
5    "Anatomical education program" means any educational
6program that utilizes whole-body donation to educate students
7about anatomy, physiology, and disease.
8    "Body donation program" means any nontransplant,
9whole-body, or anatomical donation program that preserves
10cadavers, typically for medical or scientific research.
11    "Council" means the Cadaver Advisory Council.
12    "Department" means the Department of Public Health.
13    "Director" means the Director of Public Health.
14    "Institution of higher learning" means an educational
15organization located in this State that provides at least an
16organized 2-year program of collegiate grade in the liberal
17arts, sciences, or both, directly applicable toward the
18attainment of a baccalaureate degree, or a program in health
19education directly applicable toward the attainment of a
20college certificate, diploma, or associate degree.
21    (c) The Cadaver Advisory Council is created. The Council
22shall create and maintain a document containing current
23embalming techniques, preservation practices, and air quality
24testing from universities within the State, as well as
25recommendations regarding the administration of an anatomical
26education program, which shall, at a minimum, cover all of the

1following:
2        (1) acceptance of cadavers;
3        (2) embalming and preservation procedures;
4        (3) the differences between funeral embalming and
5    embalming for medical education;
6        (4) facilities in which cadavers may be stored and
7    examined;
8        (5) security;
9        (6) use of cadavers;
10        (7) transportation of cadavers;
11        (8) maintenance of written records; and
12        (9) final disposition of cadavers.
13    (d) The document created and maintained under subsection
14(c) shall be made available on the Department's website and
15kept up to date by the Department as it is maintained by the
16Council.
17    (e) The Council shall meet at least every 6 months and at
18other times as called by the chairperson, and shall consist of
19the following members:
20        (1) The Director, or his or her designee, who shall
21    serve as chairperson.
22        (2) The Dean of the University of Illinois College of
23    Medicine, or his or her designee.
24        (3) The Dean of the Southern Illinois University School
25    of Medicine, or his or her designee.
26        (4) Two deans from independent universities with

1    approved medical schools in the State, or their designees,
2    appointed by the Director.
3        (5) One member representing a statewide organization
4    that receives, prepares, preserves, and distributes human
5    remains for the purpose of medical education and research
6    at institutions throughout Illinois, appointed by the
7    Director.
8        (6) Two members representing lab managers at
9    institutions of higher learning that have a body donation
10    program, appointed by the Director.
11        (7) Two members representing lab managers at
12    institutions of higher learning that use cadavers from
13    outsourced body donation programs, appointed by the
14    Director.
15        (8) One member from a statewide organization
16    representing funeral homes or funeral home directors in the
17    State, appointed by the Governor.
18        (9) One member appointed by the Governor.
19    (f) Members of the Council shall serve without compensation
20but may be reimbursed for their reasonable and necessary
21expenses from funds appropriated to the Department for that
22purpose, including travel, subject to the rules of the
23appropriate travel control board.
24    (g) The chairperson shall be responsible for scheduling
25meetings, setting meeting agendas, ensuring the development
26and delivery of the final report and implementation plan, and

1other administrative tasks, in consultation with Council
2members.
 
3    Section 99. Effective date. This Act takes effect July 1,
42020.
