Amends the Illinois Procurement Code. Provides that no procurement contract for the construction, alteration, operation, repair, maintenance, or improvement of any mass transit facility, or equipment thereof, in excess of $1,000,000 shall be awarded to or executed with any vendor that receives support from a nonmarket economy country, as defined under specified federal law. Provides that nothing in the provisions is intended to contravene any existing treaties, laws, trade agreements, or regulations of the United States or subsequent trade agreements entered into between any foreign countries and the State or the United States.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Procurement Code is amended by |
5 | | adding Section 30-55 as follows: |
6 | | (30 ILCS 500/30-55 new) |
7 | | Sec. 30-55. Construction contracts involving nonmarket |
8 | | economy countries. |
9 | | (a) Notwithstanding any provision of law to the contrary, |
10 | | no procurement contract for the construction, alteration, |
11 | | operation, repair, maintenance, or improvement of any mass |
12 | | transit facility, or equipment thereof, in excess of $1,000,000 |
13 | | shall be awarded to or executed with any vendor that receives |
14 | | support from a nonmarket economy country as defined in section |
15 | | 7781(18) of the Tariff Act of 1930 (19 U.S.C. 1677 (18)) and |
16 | | was identified by the United States Trade Representative in the |
17 | | most recent report required by section 182 of the Trade Act of |
18 | | 1974 (19 U.S.C. 2242) as a priority foreign country, and is |
19 | | subject to monitoring by the United States Trade Representative |
20 | | under section 306 of the Trade Act of 1974 (19 U.S.C. 2416). |
21 | | (b) Nothing in this Section is intended to contravene any |
22 | | existing treaties, laws, trade agreements, or regulations of |
23 | | the United States or subsequent trade agreements entered into |
