AMENDMENT TO SENATE BILL 3036

2    AMENDMENT NO. ______. Amend Senate Bill 3036 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Commission to End Hunger Act is amended by
5changing Section 15 as follows:
 
6    (20 ILCS 5015/15)
7    Sec. 15. Members. The Commission to End Hunger shall be
8composed of no more than 21 voting members including 2 members
9of the Illinois House of Representatives, one appointed by the
10Speaker of the House and one appointed by the House Minority
11Leader; 2 members of the Illinois Senate, one appointed by the
12Senate President and one appointed by the Senate Minority
13Leader; one representative of the Office of the Governor
14appointed by the Governor; one representative of the Office of
15the Lieutenant Governor appointed by the Lieutenant Governor;
16and 15 public members, who shall be appointed by the Governor.

1    The public members shall include 2 representatives of food
2banks; 2 representatives from other community food assistance
3programs; a representative of a statewide organization focused
4on responding to hunger; a representative from an anti-poverty
5organization; a representative of an organization that serves
6or advocates for children and youth; a representative of an
7organization that serves or advocates for older adults; a
8representative of an organization that advocates for people who
9are homeless; a representative of an organization that serves
10or advocates for persons with disabilities; a representative of
11an organization that advocates for immigrants; a
12representative of a municipal or county government; and 3
13at-large members. The appointed members shall reflect the
14racial, gender, and geographic diversity of the State and shall
15include representation from regions of the State.
16    The following officials shall serve as ex-officio members:
17the Secretary of Human Services or his or her designee; the
18State Superintendent of Education or his or her designee; the
19Director of Healthcare and Family Services or his or her
20designee; the Director of Children and Family Services or his
21or her designee; the Director of Aging or his or her designee;
22the Director of Natural Resources or his or her designee; and
23the Director of Agriculture or his or her designee. The
24African-American Family Commission and , the Latino Family
25Commission, and the Local Food, Farms, and Jobs Council shall
26each designate a liaison to serve ex-officio on the Commission.

1    Members shall serve without compensation and are
2responsible for the cost of all reasonable and necessary travel
3expenses connected to Commission business, as the State of
4Illinois will not reimburse Commission members for these costs.
5    Commission members shall be appointed within 60 days after
6the effective date of this Act. The Commission shall hold their
7initial meetings within 60 days after at least 50% of the
8members have been appointed.
9    The representative of the Office of the Governor and a
10representative of a food bank shall serve as co-chairs of the
11Commission.
12    At the first meeting of the Commission, the members shall
13select a 5-person Steering Committee that includes the
14co-chairs.
15    The Commission may establish committees that address
16specific issues or populations and may appoint individuals with
17relevant expertise who are not appointed members of the
18Commission to serve on committees as needed.
19    The Office of the Governor, or a designee of the Governor's
20choosing, shall provide guidance to the Commission. Under the
21leadership of the Office of the Governor, subject to
22appropriation, the Department of Human Services shall also
23provide leadership to support the Commission. The Department of
24Human Services and the State of Illinois shall not incur any
25costs as a result of the creation of the Commission to End
26Hunger as the coordination of meetings, report preparation, and

1other related duties will be completed by a representative of a
2food bank that is serving as a co-chair of the Commission.

4    Section 10. The Illinois Procurement Code is amended by
5changing Section 55-20 as follows:
 
6    (30 ILCS 500/55-20)
7    Sec. 55-20. Contracts for food donation; food donation
8policy.
9    (a) After the effective date of this amendatory Act of the
1099th General Assembly, a public entity shall not enter into a
11contract to purchase food with a bidder or offeror if the
12bidder's or offeror's contract terms prohibit the public entity
13from donating food to food banks, including, but not limited
14to, homeless shelters, food pantries, and soup kitchens.
15    (b) Each State agency that purchases food through a
16contract procured in accordance with entering into or
17maintaining a contract for the purchase of food under this Code
18shall adopt a policy that permits the donation of leftover food
19purchased with procured by State funds. The policy shall
20address any daily food operations run by the agency, including
21one-time events, and shall contain a list of nearby soup
22kitchens, food pantries, and other non-profit organizations
23where leftover food can be donated. Each State agency shall
24circulate its policy to all agency employees, and submit its

1food donation policy to the Department of Central Management
2Services on an annual basis beginning December 31, 2018.

4    Section 15. The Local Food, Farms, and Jobs Act is amended
5by changing Section 10 as follows:
 
6    (30 ILCS 595/10)
7    Sec. 10. Procurement goals for local farm or food products.
8    (a) In order to create, strengthen, and expand local farm
9and food economies throughout Illinois, it shall be the goal of
10this State that 20% of all food and food products purchased by
11State agencies and State-owned facilities, including, without
12limitation, facilities for persons with mental health and
13developmental disabilities, correctional facilities, and
14public universities, shall, by 2020, be local farm or food
15products.
16    (b) The State Local Food, Farms, and Jobs Council
17established under this Act shall support and encourage that 10%
18of food and food products purchased by entities funded in part
19or in whole by State dollars, which spend more than $25,000 per
20year on food or food products for its students, residents, or
21clients, including, without limitation, public schools, child
22care facilities, after-school programs, and hospitals, shall,
23by 2020, be local farm or food products.
24    (c) To meet the goals set forth in this Section, when a

1State contract for purchase of food or food products is to be
2awarded to the lowest responsible bidder, an otherwise
3qualified bidder who will fulfill the contract through the use
4of local farm or food products may be given preference over
5other bidders, provided that the cost included in the bid of
6local farm or food products is not more than 10% greater than
7the cost included in a bid that is not for local farm or food
8products.
9    (d) All State agencies and State-owned facilities that
10purchase food and food products shall, with the assistance of
11the Local Food, Farms, and Jobs Council, develop a system for
12(i) identifying the percentage of local farm or food products
13purchased for fiscal year 2019 2011 as the baseline; and (ii)
14tracking and reporting local farm or food products purchases on
15an annual basis.
16    (e) All State agencies and State-owned facilities that
17purchase food and food products shall publish on their
18applicable procurement bulletin their farm or food purchases
19for the recently completed fiscal year. The first published
20report shall be due no later than January 1, 2021 and represent
21fiscal year 2020 purchases. A report shall be due each January
221 thereafter and be published on a form prescribed by each
23applicable Chief Procurement Officer.
