1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||
4 | Section 5. The Private Detective, Private Alarm, Private | |||||||||||||||||||||
5 | Security, Fingerprint Vendor, and
Locksmith Act of 2004 is | |||||||||||||||||||||
6 | amended by changing Sections 15-25 and 25-20 as follows:

8 | (Section scheduled to be repealed on January 1, 2024)
| |||||||||||||||||||||
9 | Sec. 15-25. Training; private detective and employees.
| |||||||||||||||||||||
10 | (a) Registered employees of a private detective agency
| |||||||||||||||||||||
11 | shall complete, within 30 days of their employment, a minimum
| |||||||||||||||||||||
12 | of 20 hours of basic training provided by a qualified | |||||||||||||||||||||
13 | instructor.
The substance of the training shall be related to | |||||||||||||||||||||
14 | the work
performed by the registered employee . The training may | |||||||||||||||||||||
15 | be classroom-based or online Internet-based but shall not be | |||||||||||||||||||||
16 | conducted as on-the-job training and shall include relevant | |||||||||||||||||||||
17 | information as to the identification of terrorists, acts of | |||||||||||||||||||||
18 | terrorism, and terrorist organizations, as defined by federal | |||||||||||||||||||||
19 | and State statutes .

20 | (a-5) In addition to the basic training required in | |||||||||||||||||||||
21 | subsection (a), registered employees of a private detective | |||||||||||||||||||||
22 | agency shall complete an additional minimum of 8 hours of | |||||||||||||||||||||
23 | annual training for every calendar year, commencing with the |

| |||||||
1 | calendar year beginning after the employee's hire date. | ||||||
2 | (a-10) Annual training for registered employees shall be | ||||||
3 | based on subjects related to the work performed as determined | ||||||
4 | by the employer and may be conducted in a classroom or seminar | ||||||
5 | setting or via Internet-based online learning programs. Annual | ||||||
6 | training may not be conducted as on-the-job training. | ||||||
7 | (b) It is the responsibility of the employer to certify,
on | ||||||
8 | a form provided by the Department, that the employee has
| ||||||
9 | successfully completed the basic and annual training. The | ||||||
10 | original form or a copy shall be a
permanent record of training | ||||||
11 | completed by the employee and
shall be placed in the employee's | ||||||
12 | file with the employer for
the period the employee remains with | ||||||
13 | the employer. An agency
may place a notarized copy of the | ||||||
14 | Department form in lieu of
the original into the permanent | ||||||
15 | employee registration card
file. The original form shall be | ||||||
16 | given to the employee when
his or her employment is terminated. | ||||||
17 | Failure to return the
original form to the employee is grounds | ||||||
18 | for disciplinary
action. The employee shall not be required to | ||||||
19 | repeat the
required training once the employee has been issued | ||||||
20 | the form.
An employer may provide or require additional | ||||||
21 | training.

22 | (c) (Blank). Any certification of completion of the 20-hour | ||||||
23 | basic
training issued under the Private Detective, Private | ||||||
24 | Alarm,
Private Security, and Locksmith Act of 1993 or any prior | ||||||
25 | Act
shall be accepted as proof of training under this Act.

26 | (d) All private detectives shall complete a minimum of 8 |
| |||||||
| |||||||
1 | hours of annual training on a topic of their choosing, provided | ||||||
2 | that the subject matter is reasonably related to their private | ||||||
3 | detective practice. The annual training for private detectives | ||||||
4 | may be completed utilizing any combination of hours obtained in | ||||||
5 | a formal educational classroom setting, including, but not | ||||||
6 | limited to, a live educational workshop or seminar offered by | ||||||
7 | any industry-related product manufacturer or service provider, | ||||||
8 | any recognized state or national industry association, any | ||||||
9 | recognized continuing education provider, or by any accredited | ||||||
10 | 2-year or 4-year college or university, or through | ||||||
11 | Internet-based online training resources. | ||||||
12 | (e) The annual training requirements for private | ||||||
13 | detectives shall not apply until the calendar year following | ||||||
14 | the issuance of the private detective license. | ||||||
15 | (f) It shall be the responsibility of the private detective | ||||||
16 | to keep and maintain a personal log of all training hours | ||||||
17 | earned along with sufficient documentation for the Department | ||||||
18 | to verify the annual training completed for at least 5 years. | ||||||
19 | The personal training log and documentation shall be provided | ||||||
20 | to the Department in the same manner as other documentation and | ||||||
21 | records required under this Act. | ||||||
22 | (g) Recognizing the diverse professional practices of | ||||||
23 | private detectives licensed under this Act, it is the intent of | ||||||
24 | the training requirements in this Section to allow for a broad | ||||||
25 | interpretation of the coursework, seminar subjects, or class | ||||||
26 | topics to be considered reasonably related to the practice of |

1 | any profession licensed under this Act. | ||||||
2 | (h) Notwithstanding any other professional license a | ||||||
3 | private detective holds under this Act, no more than 8 hours of | ||||||
4 | annual training shall be required for any one year. | ||||||

8 | Sec. 25-20. Training; private security contractor and
| ||||||
9 | employees. | ||||||
10 | (a) Registered employees of the private security
| ||||||
11 | contractor agency who provide traditional guarding or other
| ||||||
12 | private security related functions or who respond to alarm
| ||||||
13 | systems shall complete, within 30 days of their employment, a
| ||||||
14 | minimum of 20 hours of classroom basic training provided by a
| ||||||
15 | qualified instructor, which shall include the following
| ||||||
16 | subjects:
| ||||||
17 | (1) The law regarding arrest and search and seizure
as | ||||||
18 | it applies to private security.
| ||||||
19 | (2) Civil and criminal liability for acts related
to | ||||||
20 | private security.
| ||||||
21 | (3) The use of force, including but not limited to
the | ||||||
22 | use of nonlethal force (i.e., disabling spray, baton,
| ||||||
23 | stungun , taser, or similar weapon).
| ||||||
24 | (4) Verbal communication skills Arrest and control | ||||||
25 | techniques .

1 | (5) The offenses under the Criminal Code of 2012
that | ||||||
2 | are directly related to the protection of persons and
| ||||||
3 | property.
| ||||||
4 | (6) Private security officers and the criminal justice | ||||||
5 | system The law on private security forces and on
reporting | ||||||
6 | to law enforcement agencies .
| ||||||
7 | (7) Fire prevention, fire equipment, and fire
safety.
| ||||||
8 | (8) Report The procedures for
report writing and | ||||||
9 | observation techniques .
| ||||||
10 | (9) Customer service Civil rights and public | ||||||
11 | relations.
| ||||||
12 | (10) The identification of terrorists, acts of | ||||||
13 | terrorism, and terrorist organizations, as defined by | ||||||
14 | federal and State statutes.
| ||||||
15 | (b) All other employees of a private security contractor
| ||||||
16 | agency shall complete a minimum of 20 hours of training
| ||||||
17 | provided by the qualified instructor within 30 days of their
| ||||||
18 | employment. The substance of the training shall be related to
| ||||||
19 | the work performed by the registered employee.
| ||||||
20 | (c) Registered employees of the private security | ||||||
21 | contractor agency who
provide
guarding or other private | ||||||
22 | security related functions, in addition to the
classroom | ||||||
23 | training
required under subsection (a), within 6 months of | ||||||
24 | their employment,
shall complete
an additional 8 hours of | ||||||
25 | training on subjects to be determined by the
employer, which
| ||||||
26 | training may be site-specific and may be conducted on the job.

1 | (d) In addition to the basic training provided for in | ||||||
2 | subsections (a) and
(c),
registered employees of the private | ||||||
3 | security contractor agency who provide
guarding or other
| ||||||
4 | private security related functions
shall complete an
| ||||||
5 | additional
8 hours of refresher training on subjects to be | ||||||
6 | determined by the
employer
each calendar year commencing with | ||||||
7 | the
calendar year
following the employee's first employment | ||||||
8 | anniversary date,
which
refresher training may be | ||||||
9 | site-specific and may be conducted on the job.
| ||||||
10 | (e) It is the responsibility of the employer to certify,
on | ||||||
11 | a form provided by the Department, that the employee has
| ||||||
12 | successfully completed the basic and refresher training. The | ||||||
13 | original
form or a copy shall be a permanent record of training | ||||||
14 | completed by the
employee and shall be placed in the employee's | ||||||
15 | file with the
employer for the period the employee remains with | ||||||
16 | the
employer. An agency may place a notarized copy of the

4 | minimum of 8 hours of annual training on a topic of their | ||||||
5 | choosing, provided that the subject matter of the training is | ||||||
6 | reasonably related to their private security contractor | ||||||
7 | practice. A minimum of 4 hours of the annual training must be | ||||||
8 | completed in a formal educational classroom setting, | ||||||
9 | including, but not limited to, a live continuing education | ||||||
10 | seminar offered by any recognized state or national industry | ||||||
11 | association, any recognized continuing education provider, or | ||||||
12 | by any 2-year or 4-year college or university. No more than 4 | ||||||
13 | hours of the annual training may be completed utilizing online | ||||||
14 | training materials, online videos, or other similar training | ||||||
15 | materials available via the Internet or through the reading of | ||||||
16 | professional journals or publications. | ||||||
17 | (h) It shall be the responsibility of the private security | ||||||
18 | contractor to keep and maintain a personal log of all training | ||||||
19 | hours earned along with sufficient documentation necessary for | ||||||
20 | the Department to verify the annual training completed for at | ||||||
21 | least 5 years. The personal training log and documentation | ||||||
22 | shall be provided to the Department in the same manner as other | ||||||
23 | documentation and records required under this Act. | ||||||
24 | (i) Recognizing the diverse professional practices of | ||||||
25 | private security contractors licensed under this Act, it is the | ||||||
26 | intent of the training requirements in this Section to allow |

1 | for a broad interpretation of the coursework, seminar subjects, | ||||||
2 | or class topics to be considered reasonably related to the | ||||||
3 | practice of any profession licensed under this Act. | ||||||
4 | (j) Notwithstanding any other professional license a | ||||||
5 | private security contractor holds under this Act, no more than | ||||||
6 | 8 hours of annual training shall be required for any one year. | ||||||
7 | (k) The annual training requirements for private security | ||||||
8 | contractors shall not apply until the calendar year following | ||||||
