AMENDMENT TO SENATE BILL 2397

2    AMENDMENT NO. ______. Amend Senate Bill 2397 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Hospital Act is
5amended by adding Section 7.1 as follows:
 
6    (110 ILCS 330/7.1 new)
7    Sec. 7.1. Infection preventionists.
8    (a) For the purposes of this Section, "infection
9preventionist" means a person designated by the University of
10Illinois Hospital to identify infectious disease processes,
11conduct surveillance and epidemiologic investigations, and
12develop plans to prevent and control the transmission of
13infectious agents within the University of Illinois Hospital.
14    (b) A person shall not function as an infection
15preventionist at the University of Illinois Hospital, and the
16University of Illinois Hospital shall not employ or contract

1for the services of an infection preventionist, unless the
2person meets one of the following requirements:
3        (1) The person has successfully passed an exam from a
4    nationally accredited infection prevention and
5    epidemiology accrediting organization and holds and
6    maintains certification in infection prevention and
7    control from a nationally accredited infection prevention
8    and epidemiology certification organization.
9        (2) The person provides evidence that he or she was
10    employed or otherwise contracted to provide services as an
11    infection preventionist in a hospital for a cumulative
12    period of one year within the 4 years immediately preceding
13    the effective date of this amendatory Act of the 101st
14    General Assembly. Any contractor or employer of an
15    infection preventionist on the effective date of this
16    amendatory Act of the 101st General Assembly shall confirm
17    in a writing to each infection preventionist of the
18    infection preventionist's contract or employment in that
19    capacity.
20        (3) The person is a student or intern performing the
21    functions of an infection preventionist, is under the
22    direct supervision of an infection preventionist
23    appropriately certified under paragraph (1) of this
24    subsection, and is functioning within the scope of a
25    student's or intern's training.
26    (c) A person who functions as an infection preventionist as

1provided in paragraph (2) of subsection (b) shall have 3 years
2from the date of hire to obtain the infection preventionist
3credentials outlined in paragraph (1) of subsection (b).
4    (d) The University of Illinois Hospital may employ or
5contract with a person who does not meet the requirements under
6subsection (b) as an infection preventionist if:
7        (1) after a diligent and thorough effort has been made,
8    the University of Illinois Hospital is unable to employ or
9    contract with a sufficient number of infection
10    preventionists who meet the requirements under subsection
11    (b); and
12        (2) the University of Illinois Hospital makes a written
13    record of its efforts to employ or contract with a
14    sufficient number of infection preventionists who meet the
15    requirements under subsection (b) and retains those
16    records at the University of Illinois Hospital.
17    The person must meet the requirements under paragraph (1)
18of subsection (b) within 3 years after the start of employment
19or contracting as an infection preventionist.
20    (e) If the University of Illinois Hospital employs or
21contracts with an infection preventionist, the University of
22Illinois Hospital shall, upon request of another hospital or an
23infection preventionist employed by, formerly employed by, or
24contracted to perform as an infection preventionist at the
25University of Illinois Hospital, verify the dates of employment
26or contract of the infection preventionist.

1    (f) Nothing in this Section shall prohibit any person from
2performing an infection preventionist's tasks or functions if
3the person is acting within the scope of his or her practice.
4Nothing in this Section shall be construed to prevent or
5restrict the practice, provision of services, or activities of
6any person licensed or registered in this State under any other
7law from engaging in the profession or occupation for which he
8or she is licensed or registered.
9    (g) The Department of Public Health may adopt rules to
10implement and administer this Section.
 
11    Section 10. The Hospital Licensing Act is amended by adding
12Section 6.23b as follows:
 
13    (210 ILCS 85/6.23b new)
14    Sec. 6.23b. Infection preventionists.
15    (a) For the purposes of this Section, "infection
16preventionist" means a person designated by a hospital to
17identify infectious disease processes, conduct surveillance
18and epidemiologic investigations, and develop plans to prevent

20hospital.
