AMENDMENT TO SENATE BILL 2346

2    AMENDMENT NO. ______. Amend Senate Bill 2346 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Children and Family Services Act is amended
5by changing Section 35.7 as follows:
 
6    (20 ILCS 505/35.7)
7    Sec. 35.7. Error Reduction Training Implementations Plans;
8Inspector General.
9    (a) The Inspector General of the Department of Children and
10Family Services shall develop Error Reduction Training
11Implementation Plans, as necessary, to remedy patterns of
12errors or problematic practices that compromise or threaten the
13safety of children as identified in the DCFS Office of the
14Inspector General (OIG) death or serious injury
15investigations, and Child Death Review Teams recommendations,
16or by the Director of the Department. The Error Reduction

1Training Implementation Plans shall include both classroom and
2web-based trainings. The Office of the Inspector General shall
3develop the curricula, provide for the initial training
4presentations, and collaborate with, and as needed, use the
5Child Protection Training Academy simulation model. Initial
6trainings shall include, but not be limited to, strengthening
7critical thinking, decision-making, interviewing, analytical,
8and problem-solving skills, as well as practice reviews and
9recertifications. Following the initial training roll-out by
10the OIG, the Department's Division of Quality Enhancement shall
11identify outcome measures and track compliance with the
12training curriculum. Each quarter, the Department's Division
13of Quality Enhancement shall prepare a report detailing
14compliance with the Error Reduction Training and alert the
15Director to staffing needs or other needs to accomplish the
16goals of the Error Reduction Training. The report shall be
17transmitted to the Director, the OIG, and all management staff
18involved in the Error Reduction Training. The Department's
19Office of Learning and Professional Development shall work with
20the Inspector General to implement trainings and continue to
21provide ongoing trainings on the identified topic for
22Department staff as well as for the employees of the
23Department's private agency partners. The Department's Office
24of Learning and Professional Development shall work to ensure
25adherence to the Error Reduction Training, and shall maintain
26systems to continue reform efforts in an ongoing manner.

1training and on-site components. The Inspector General shall
2submit proposed Error Reduction Implementation Plans to the
3Director for review. The Director may approve the plans
4submitted, or approve plans amended by the Office of the
5Inspector General, taking into consideration policies and
6procedures that govern the function and performance of any
7affected frontline staff. The Director shall document the basis
8for disapproval of any submitted or amended plan. The
9Department shall deploy Error Reduction Safety Teams to
10implement the Error Reduction Implementation Plans. The Error
11Reduction Safety Teams shall be composed of Quality Assurance
12and Division of Training staff to implement hands-on training
13and Error Reduction Implementation Plans. The teams shall work
14in the offices of the Department or of agencies, or both, as
15required by the Error Reduction Implementation Plans, and shall
16work to ensure that systems are in place to continue reform
17efforts after the departure of the teams. The Director shall
18develop a method to ensure consistent compliance with any Error
19Reduction Training Implementation Plans, the provisions of
20which shall be incorporated into the plan.
21    (b) The Department's Division of Quality Enhancement, in
22collaboration with the OIG, Quality Assurance shall prepare
23public reports semiannually annually detailing the following:
24the substance of any Error Reduction Training Implementation
25Plan approved; any deviations from the Error Reduction Training
26models Plan; whether adequate staff was available to perform

1functions necessary to the Error Reduction Training
2Implementation Plan, including identification and reporting of
3any staff needs; other problems noted or barriers to
4implementing the Error Reduction Training Implementation Plan;
5and recommendations for additional training, amendments to
6rules and procedures, or other systemic reform identified by
7either the OIG or the Office of Learning and Professional
8Development or as identified from staff training evaluations
9and feedback. the teams. Quality Assurance shall work with
10affected frontline staff to implement provisions of the
11approved Error Reduction Implementation Plans related to staff
12function and performance.
13    (c) The OIG shall serve as subject matter experts regarding
14training content and may, when necessary, review, evaluate, and
15provide direction for the instructional integrity of the
16training and the delivery method of the content being used for
17the purposes of either preservice or service training of staff.
18The Error Reduction Teams shall implement training and reform
19protocols through incubating change in each region, Department
20office, or purchase of service office, as required. The teams
21shall administer hands-on assistance, supervision, and
22management while ensuring that the office, region, or agency
23develops the skills and systems necessary to incorporate
24changes on a permanent basis. For each Error Reduction
25Implementation Plan, the Team shall determine whether adequate
26staff is available to fulfill the Error Reduction

1Implementation Plan, provide case-by-case supervision to
2ensure that the plan is implemented, and ensure that management
3puts systems in place to enable the reforms to continue. Error
4Reduction Teams shall work with affected frontline staff to
5ensure that provisions of the approved Error Reduction
6Implementation Plans relating to staff functions and
7performance are achieved to effect necessary reforms.
8    (d) The OIG shall develop and submit new Error Reduction
9Trainings Implementation Plans as necessary. To implement each
10Error Reduction Training Implementation Plan, as approved by
11the Director, the OIG shall work with the Office of Learning
12and Professional Development and the Division of Quality
13Enhancement. Quality Assurance members of the Error Reduction
14Teams designated by the Department. The teams shall be
15comprised of staff from Quality Assurance and Training.
16Training shall work with the OIG and with the child death
17review teams to develop a curriculum to address errors
18identified that compromise the safety of children. Following
19the training roll-out, the Teams shall work on-site in
20identified offices. The Teams shall review and supervise all
21work relevant to the Error Reduction Implementation Plan.
22Quality Assurance shall identify outcome measures and track
23compliance with the training curriculum. Each quarter, Quality
24Assurance shall prepare a report detailing compliance with the
25Error Reduction Implementation Plan and alert the Director to
26staffing needs or other needs to accomplish the goals of the

1Error Reduction Implementation Plan. The report shall be
2transmitted to the Director, the OIG, and all management staff
3involved in the Error Reduction Implementation Plan.
4    (e) The Director shall review semiannual quarterly Quality
5Enhancement Assurance reports and determine adherence to the
6Error Reduction Training Implementation Plan using criteria
7and standards developed by the Department. The Director, or his
8or her designee, shall meet, at a minimum, semiannually, and
9when necessary quarterly with Quality Enhancement, OIG, and all
10management staff involved in the Error Reduction Training to
11discuss the reports and may adjust the content of the Error
12Reduction Trainings.
