2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Commerce and Economic | ||||||||||||||||||||||||||
5 | Opportunity Law of the
Civil Administrative Code of Illinois is | ||||||||||||||||||||||||||
6 | amended by adding Sections 605-1043 and 605-1045 as follows: | ||||||||||||||||||||||||||
7 | (20 ILCS 605/605-1043 new) | ||||||||||||||||||||||||||
8 | Sec. 605-1043. Office of Inclusion. | ||||||||||||||||||||||||||
9 | (a) The Office of Inclusion is hereby created within the | ||||||||||||||||||||||||||
10 | Department. The Office shall assist minority-owned businesses, | ||||||||||||||||||||||||||
11 | women-owned businesses, veteran-owned businesses and | ||||||||||||||||||||||||||
12 | businesses owned by persons with disabilities through targeted | ||||||||||||||||||||||||||
13 | programs, resources, and outreach and promotional activities. | ||||||||||||||||||||||||||
14 | The Office shall engage in or conduct the following activities: | ||||||||||||||||||||||||||
15 | (1) promoting and conducting outreach efforts with | ||||||||||||||||||||||||||
16 | respect to the making of small business loans pursuant to | ||||||||||||||||||||||||||
17 | Section 9-4.3 of the Build Illinois Act and assisting | ||||||||||||||||||||||||||
18 | minority-owned businesses, women-owned businesses, | ||||||||||||||||||||||||||
19 | veteran-owned businesses and businesses owned by persons | ||||||||||||||||||||||||||
20 | with disabilities in applying for and receiving loan funds | ||||||||||||||||||||||||||
21 | under that Act; | ||||||||||||||||||||||||||
22 | (2) providing and hosting workshops and public forums | ||||||||||||||||||||||||||
23 | and engaging in outreach efforts for minority-owned |

1 | businesses, women-owned businesses, veteran-owned | ||||||
2 | businesses and businesses owned by persons with | ||||||
3 | disabilities to encourage participation in programs | ||||||
4 | authorized by the Business Enterprise for Minorities, | ||||||
5 | Women and Persons with Disabilities Act and the Illinois | ||||||
6 | Procurement Code; | ||||||
7 | (3) providing and hosting workshops and public forums | ||||||
8 | and engaging in outreach efforts that assist and educate | ||||||
9 | minority-owned businesses, women-owned businesses, | ||||||
10 | veteran-owned businesses and businesses owned by persons | ||||||
11 | with disabilities on the process of applying for and | ||||||
12 | becoming certified to apply for State grant funds under the | ||||||
13 | Grant Accountability and Transparency Act; and | ||||||
14 | (4) providing and hosting workshops and public forums | ||||||
15 | and engaging in outreach efforts that assist and educate | ||||||
16 | aspiring and existing minority-owned businesses, | ||||||
17 | women-owned businesses, veteran-owned businesses, and | ||||||
18 | businesses owned by persons with disabilities in | ||||||
19 | understanding concepts such as, but not limited to, | ||||||
20 | business formation, business planning, capital access, and | ||||||
21 | marketing a business. | ||||||
22 | (b) In order to facilitate and encourage the growth of | ||||||
23 | supplier diversity, the Office may have at least one employee | ||||||
24 | that serves as a supplier diversity program manager to (i) | ||||||
25 | collect reports and information concerning entities that | ||||||
26 | manage supplier diversity programs and (ii) conduct public |

1 | workshops focused on specific industries to collaboratively | ||||||
2 | connect diverse enterprises with entities that manage supplier | ||||||
3 | diversity programs. Those workshops shall be modeled after | ||||||
4 | Illinois Commerce Commission hearings for utilities and | ||||||
5 | railroads and shall include a collaborative discussion of filed | ||||||
6 | supplier diversity reports. The program manager shall hold | ||||||
7 | public workshops for relevant industries including, but not | ||||||
8 | limited to, gaming, hospitals, and public and private higher | ||||||
9 | education. Those workshops shall be held on the following | ||||||
10 | schedule: | ||||||
11 | (1) gaming: February; | ||||||
12 | (2) hospitals: April; | ||||||
13 | (3) public and private higher education: July; and | ||||||
14 | (4) Economic Development for a Growing Economy (EDGE) | ||||||
15 | tax credit: September. | ||||||
16 | (c) The Department shall publish a template for supplier | ||||||
17 | diversity reports to be used for EDGE tax credit recipients and | ||||||
18 | private higher education institutions. The reports for private | ||||||
19 | higher education and EDGE tax credit recipients shall contain | ||||||
20 | the following provisions: | ||||||
21 | (1) the name, address, phone number and email address | ||||||
22 | of the point of contact for potential vendors to register | ||||||
23 | with the entity; | ||||||
24 | (2) local, State, or private certifications that the | ||||||
25 | entity accepts or recognizes for minority- and women-owned | ||||||
26 | businesses; |

1 | (3) the voluntary supplier diversity goals, if any, for | ||||||
2 | the next fiscal year for the entire budget of the entity; | ||||||
3 | (4) for the last fiscal year, the actual contractual | ||||||
4 | spending for the entire budget of the entity and the actual | ||||||
5 | spending for minority-owned and women-owned businesses, | ||||||
6 | expressed both as actual dollars and as a percentage of the | ||||||
7 | total budget for actual spending for the entity; | ||||||
8 | (5) narrative explaining the results of the report and | ||||||
9 | the tactics to be employed to achieve the voluntary goals | ||||||
10 | for the next fiscal year; and | ||||||
11 | (6) the particular areas of spending in the next fiscal | ||||||
12 | year that the entity intends to procure that are most | ||||||
13 | relevant to minority-owned and women-owned businesses. | ||||||
14 | (d) In addition, the Office shall compile and publish on | ||||||
15 | its website a master database for all points of contract, | ||||||
16 | certifications accepted, and links to the most recent supplier | ||||||
17 | diversity reports submitted to the Department under: | ||||||
18 | (1) Section 405-530 of the Department of Central | ||||||
19 | Management Services Law of the Civil Administrative Code of | ||||||
20 | Illinois; | ||||||
21 | (2) Section 5.3 of the Illinois Health Facilities | ||||||
22 | Planning Act; | ||||||
23 | (3) Section 8f of the Business Enterprise for | ||||||
24 | Minorities, Women, and Persons with Disabilities Act; | ||||||
25 | (4) Section 5-57 of the Economic Development for a | ||||||
26 | Growing Economy Tax Credit Act; |

1 | (5) Section 5-117 of the Public Utilities Act; | ||||||
2 | (6) Section 12.2 of the Illinois Horse Racing Act of | ||||||
3 | 1975; and | ||||||
4 | (7) Section 10 of the Railroad Supplier Diversity Act. | ||||||
5 | (e) The Office shall administer programs established by the | ||||||
6 | Department, the General Assembly, or both and shall provide | ||||||
7 | grants to minority-owned business, woman-owned businesses, | ||||||
8 | veteran-owned businesses, and businesses owned by persons with | ||||||
9 | disabilities. The Office may establish applications, | ||||||
10 | notifications, contracts, and other forms or procedures and may | ||||||
11 | use vendors or contract work to carry out the purposes of this | ||||||
12 | Act. The Office may coordinate assistance for businesses with | ||||||
13 | other State agencies. | ||||||
14 | (f) The Department shall provide staff, administrative | ||||||
15 | support, and related support to the Office as required to | ||||||
16 | administer this Section and may adopt rules to administer this | ||||||
17 | Section. | ||||||
18 | (20 ILCS 605/605-1045 new) | ||||||
19 | Sec. 605-1045. Higher education supplier diversity report. | ||||||
20 | Every private institution of higher education approved by the | ||||||
21 | Illinois Student Assistance Commission for the purposes of the | ||||||
22 | Monetary Award Program shall submit a 2-page report on its | ||||||
23 | voluntary supplier diversity program to the Department in the | ||||||
24 | form and manner required by the Department by April 1 of every | ||||||
25 | year. The Department shall hold an annual workshop open to the |

1 | public with leaders of private institutions of higher education | ||||||
2 | and minority-owned and women-owned businesses in July of every | ||||||
3 | year.

4 | Section 99. Effective date. This Act takes effect upon | ||||||
5 | becoming law. |
