SYNOPSIS AS INTRODUCED:
 
20 ILCS 605/605-1043 new
20 ILCS 605/605-1045 new

    Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Creates the Office of Inclusion within the Department of Commerce and Economic Opportunity to assist minority-owned businesses, women-owned businesses, veteran-owned businesses, and businesses owned by persons with disabilities. Provides that private institutions of higher education approved by the Illinois Student Assistance Commission for the purposes of the Monetary Award Program shall submit supplier diversity reports to the Department of Commerce and Economic Opportunity. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Commerce and Economic
5Opportunity Law of the Civil Administrative Code of Illinois is
6amended by adding Sections 605-1043 and 605-1045 as follows:
 
7    (20 ILCS 605/605-1043 new)
8    Sec. 605-1043. Office of Inclusion.
9    (a) The Office of Inclusion is hereby created within the
10Department. The Office shall assist minority-owned businesses,
11women-owned businesses, veteran-owned businesses and
12businesses owned by persons with disabilities through targeted
13programs, resources, and outreach and promotional activities.
14The Office shall engage in or conduct the following activities:
15        (1) promoting and conducting outreach efforts with
16    respect to the making of small business loans pursuant to
17    Section 9-4.3 of the Build Illinois Act and assisting
18    minority-owned businesses, women-owned businesses,
19    veteran-owned businesses and businesses owned by persons
20    with disabilities in applying for and receiving loan funds
21    under that Act;
22        (2) providing and hosting workshops and public forums
23    and engaging in outreach efforts for minority-owned

1    businesses, women-owned businesses, veteran-owned
2    businesses and businesses owned by persons with
3    disabilities to encourage participation in programs
4    authorized by the Business Enterprise for Minorities,
5    Women and Persons with Disabilities Act and the Illinois
6    Procurement Code;
7        (3) providing and hosting workshops and public forums
8    and engaging in outreach efforts that assist and educate
9    minority-owned businesses, women-owned businesses,
10    veteran-owned businesses and businesses owned by persons
11    with disabilities on the process of applying for and
12    becoming certified to apply for State grant funds under the
13    Grant Accountability and Transparency Act; and
14        (4) providing and hosting workshops and public forums
15    and engaging in outreach efforts that assist and educate
16    aspiring and existing minority-owned businesses,
17    women-owned businesses, veteran-owned businesses, and
18    businesses owned by persons with disabilities in
19    understanding concepts such as, but not limited to,
20    business formation, business planning, capital access, and
21    marketing a business.
22    (b) In order to facilitate and encourage the growth of
23supplier diversity, the Office may have at least one employee
24that serves as a supplier diversity program manager to (i)
25collect reports and information concerning entities that
26manage supplier diversity programs and (ii) conduct public

1workshops focused on specific industries to collaboratively
2connect diverse enterprises with entities that manage supplier
3diversity programs. Those workshops shall be modeled after
4Illinois Commerce Commission hearings for utilities and
5railroads and shall include a collaborative discussion of filed
6supplier diversity reports. The program manager shall hold
7public workshops for relevant industries including, but not
8limited to, gaming, hospitals, and public and private higher
9education. Those workshops shall be held on the following
10schedule:
11        (1) gaming: February;
12        (2) hospitals: April;
13        (3) public and private higher education: July; and
14        (4) Economic Development for a Growing Economy (EDGE)
15    tax credit: September.
16    (c) The Department shall publish a template for supplier
17diversity reports to be used for EDGE tax credit recipients and
18private higher education institutions. The reports for private
19higher education and EDGE tax credit recipients shall contain
20the following provisions:
21        (1) the name, address, phone number and email address
22    of the point of contact for potential vendors to register
23    with the entity;
24        (2) local, State, or private certifications that the
25    entity accepts or recognizes for minority- and women-owned
26    businesses;

1        (3) the voluntary supplier diversity goals, if any, for
2    the next fiscal year for the entire budget of the entity;
3        (4) for the last fiscal year, the actual contractual
4    spending for the entire budget of the entity and the actual
5    spending for minority-owned and women-owned businesses,
6    expressed both as actual dollars and as a percentage of the
7    total budget for actual spending for the entity;
8        (5) narrative explaining the results of the report and
9    the tactics to be employed to achieve the voluntary goals
10    for the next fiscal year; and
11        (6) the particular areas of spending in the next fiscal
12    year that the entity intends to procure that are most
13    relevant to minority-owned and women-owned businesses.
14    (d) In addition, the Office shall compile and publish on
15its website a master database for all points of contract,
16certifications accepted, and links to the most recent supplier
17diversity reports submitted to the Department under:
18        (1) Section 405-530 of the Department of Central
19    Management Services Law of the Civil Administrative Code of
20    Illinois;
21        (2) Section 5.3 of the Illinois Health Facilities
22    Planning Act;
23        (3) Section 8f of the Business Enterprise for
24    Minorities, Women, and Persons with Disabilities Act;
25        (4) Section 5-57 of the Economic Development for a
26    Growing Economy Tax Credit Act;

1        (5) Section 5-117 of the Public Utilities Act;
2        (6) Section 12.2 of the Illinois Horse Racing Act of
3    1975; and
4        (7) Section 10 of the Railroad Supplier Diversity Act.
5    (e) The Office shall administer programs established by the
6Department, the General Assembly, or both and shall provide
7grants to minority-owned business, woman-owned businesses,
8veteran-owned businesses, and businesses owned by persons with
9disabilities. The Office may establish applications,
10notifications, contracts, and other forms or procedures and may
11use vendors or contract work to carry out the purposes of this
12Act. The Office may coordinate assistance for businesses with
13other State agencies.
14    (f) The Department shall provide staff, administrative
15support, and related support to the Office as required to
16administer this Section and may adopt rules to administer this
17Section.

19    Sec. 605-1045. Higher education supplier diversity report.
20Every private institution of higher education approved by the
21Illinois Student Assistance Commission for the purposes of the
22Monetary Award Program shall submit a 2-page report on its
23voluntary supplier diversity program to the Department in the
24form and manner required by the Department by April 1 of every
25year. The Department shall hold an annual workshop open to the

1public with leaders of private institutions of higher education
2and minority-owned and women-owned businesses in July of every
3year.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
