Amends the Illinois Police Training Act. Provides that the Law Enforcement Training Assistance Fund is created as a nonappropriated State trust fund within the State treasury. Provides that all gifts, donations, and charitable contributions that are contributed by any public or private individual or entity to the Illinois Law Enforcement Training Standards Board for the purpose of supporting local law enforcement training shall be deposited into this Fund. Amends the Law Enforcement Intern Training Act. Creates the Correctional Officer Intern Program. To be eligible to participate, the person must meet the minimum criteria established by the Illinois Law Enforcement Training Standards Board that includes, but is not limited to, physical fitness standards, educational standards, psychological standards, being at least 21 years of age, of good character, and not convicted of a felony offense or other crime involving moral turpitude under the laws of this State or any other State that, if convicted in this State, would be punishable as a felony or a crime of moral turpitude. Provides that the Board shall require correctional interns to undertake, at a minimum, the same training requirements as established for correctional officers. Provides that the Board certificate reserved for correctional officers shall not be awarded until the correctional intern is employed, has successfully completed the State certification exam, and meets the requirements. Makes other conforming changes. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The State Finance Act is amended by adding |
5 | | Section 5.891 as follows: |

7 | | Sec. 5.891. The Law Enforcement Training Assistance Fund. |
8 | | Section 10. The Illinois Police Training Act is amended by |
9 | | adding Section 10.23 as follows: |

11 | | Sec. 10.23. Law Enforcement Training Assistance Fund. The |
12 | | Law Enforcement Training Assistance Fund is created as a |
13 | | nonappropriated State trust fund within the State treasury. All |
14 | | gifts, donations, and charitable contributions that are |
15 | | contributed by any public or private individual or entity to |
16 | | the Board for the purpose of supporting local law enforcement |
17 | | training shall be deposited into this Fund. All money in the |
18 | | Fund shall not be subject to appropriation and shall be used by |
19 | | the Board for the purpose of supporting local law enforcement |
20 | | training. Investment income that is attributable to the |
21 | | investment of moneys in the Law Enforcement Training Assistance |

1 | | Fund shall be retained in the Fund for the uses specified in |
2 | | this Section. The Fund is not subject to sweeps, administrative |
3 | | charge-backs, or any other fiscal or budgetary maneuver that |
4 | | would in any way transfer any amounts from Fund into any other |
5 | | fund of the State. |
6 | | Section 15. The Law Enforcement Intern Training Act is |
7 | | amended by changing Sections 5, 10, 15, 20, and 25 and by |
8 | | adding Sections 22 and 23 as follows:

10 | | Sec. 5. Definitions. As used in this Act:
|
11 | | "Academy" means a school certified by the Illinois Law |
12 | | Enforcement Training Standards Board to provide basic training |
13 | | under Section 6 of the
Illinois Police Training Act.

14 | | "Board" means the Illinois Law Enforcement Training |
15 | | Standards Board
created by the Illinois Police Training Act.
|
16 | | "Correctional Intern" means a civilian who has met the |
17 | | requirements to enter the Correctional Intern Training Program |
18 | | and who is not employed as a correctional officer under the |
19 | | Illinois Police Training Act. |
20 | | "Graduate Correctional Intern" means a civilian who has |
21 | | successfully completed the correctional intern training course |
22 | | and is not employed as a correctional officer under the |
23 | | Illinois Police Training Act. |
24 | | "Law Enforcement Intern" means a civilian who has met the |

2 | | Program and who is not employed as a
law enforcement officer |

8 | | "Trainee" means a law enforcement intern who is enrolled in |
9 | | the Law
Enforcement Intern Training Program.

12 | | Sec. 10. Initiation, administration, and conduct of |
13 | | program by Board. The
Board may initiate, administer, and |
14 | | conduct the Law Enforcement Intern Training
Program and the |
15 | | Correctional Officer Intern Program . The training for law |
16 | | enforcement interns shall be provided at any
certified academy |
17 | | selected by the Board. The Board shall have the authority to
|
18 | | establish enrollment limitations.

21 | | Sec. 15. Election to participate in the Law Enforcement |
22 | | Intern Training Program program . Any person may elect to

9 | | not take the place of or prevent a law enforcement officer from |
10 | | entering
an academy class to meet the basic training |
11 | | requirements set forth in the
Illinois Police Training Act. |
12 | | When reviewing applications, special consideration shall be |
13 | | given to persons who have been members of the Armed Forces of |
14 | | the United States in accordance with the Veterans Preference |
15 | | Act. The Board's investigators shall enforce the
provisions of

16 | | this Act to ensure compliance with the Act, including, but not |
17 | | limited to,
administrating a criminal justice background check |
18 | | that includes State and
federal criminal histories, conducting |
19 | | interviews, obtaining, by subpoena if
necessary, investigative |
20 | | records, police records, personnel records, or other
records |
21 | | that may be needed.
|
22 | | Nothing in this Act shall override or replace, preempt, or |
23 | | supersede, any
hiring or selection standard, process, |
24 | | procedure, requirement, or mechanism
established by any local |
25 | | governmental unit, or State statute or regulation
that is in |
26 | | effect or amended hereafter.

3 | | Sec. 20. Law enforcement certification Certification ; |
4 | | transition course. The Board shall require law
enforcement |
5 | | interns to undertake, at
a minimum, the same training |
6 | | requirements as established for law enforcement
officers under |
7 | | the Illinois Police Training Act. The Board certificate
|
8 | | reserved for law
enforcement officers shall not be awarded |
9 | | until the law enforcement intern is
employed, has successfully |

certificate, must then meet the requirements of the |
17 | | Illinois Police Training
Act upon

18 | | enforcement intern who is not employed within one
year, but is |
19 | | hired within 2 years after completing the course, must

20 | | successfully complete a transition course approved by the |
21 | | Illinois Law
Enforcement Training Standards Board and again |
22 | | successfully
complete the law enforcement State certification

23 | | exam in order to obtain the Board's certificate reserved for |
24 | | law enforcement
officers. The transition course shall consist |
25 | | of a minimum of 80 hours and
shall be conducted at a Board |

collect, or receive fees, tuition, or moneys from |
2 | | persons electing to enter the
Law Enforcement Intern Training |
3 | | Program or the Correctional Officer Intern Program equivalent |
4 | | to the costs of providing
personnel, equipment, services, and |
5 | | training to law enforcement interns that,
in
the judgement of |
6 | | the Board, are in the best interest of the State.
|
7 | | All fees or moneys received by the Board under this Act |
8 | | shall be deposited in
a special fund in the State Treasury to |
9 | | be known as the Police Training Board
Services Fund. The moneys |
10 | | deposited in the Police Training Board Services Fund
shall be |
11 | | appropriated to the Board for expenses of the
Board for the |
12 | | administration and conduct of training.
