1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the |
5 | | Complete Streets Act. |
6 | | Section 5. Definitions.
As used in this Act: |
7 | | "Advisory Board" means the Complete Streets Advisory |
8 | | Board.
|
9 | | "Department" means the Department of Transportation.
|
10 | | "Multimodal" means the various modes of travel or |
11 | | transportation, including travel by motor vehicle, bicycling, |
12 | | and walking.
|
13 | | "Multimodal planning" or "multimodal transportation |
14 | | planning" means plans concerning the improvement of the various |
15 | | modes of transportation in terms of safety, access, and |
16 | | mobility for users.
|
17 | | "User" or "users" means pedestrians, bicyclists, public |
18 | | transportation vehicles and their passengers, motorists, |
19 | | transporters of commercial goods, persons with disabilities, |
20 | | older adults, and children.
|
21 | | Section 10. Transportation planning requirements.
|
22 | | (a) Vehicular, public transportation, bicycle, and |

1 | | pedestrian modes of travel are integral to the transportation |
2 | | system, and the Illinois Department of Transportation shall |
3 | | view all transportation improvements as opportunities to |
4 | | improve safety, access, and mobility for all travelers.
|
5 | | (b) All transportation projects receiving federal or State |
6 | | funds shall work to improve safety, access, and mobility for |
7 | | users of all ages and abilities, including pedestrians, |
8 | | bicyclists, public transportation vehicles and their |
9 | | passengers, motorists, transporters of commercial goods, |
10 | | persons with disabilities, older adults, and children.

11 | | (c) Accommodations for all users shall be included in the |
12 | | planning, design, construction, reconstruction, |
13 | | rehabilitation, maintenance, and operations of any State, |
14 | | county, or local transportation facility receiving funds from |
15 | | the Department. The Department shall aim to create a safe, |
16 | | comprehensive, integrated, and connected network to |
17 | | accommodate all users in a manner that is suitable to the |
18 | | rural, suburban, or urban context.

19 | | (d) The Department shall use the latest and best design |
20 | | standards as applied to bicycle, pedestrian, transit, and |
21 | | highway facilities, including the latest editions of the |
22 | | following resources:
|
23 | | (1) A Policy on Geometric Design of Highways and |
24 | | Streets;
|
25 | | (2) Designing Walkable Urban Thoroughfares: A Context |
26 | | Sensitive Approach: An ITE Recommended Practice;

1 | | (3) Guide for the Development of Bicycle Facilities;
|
2 | | (4) Guide for the Planning, Design, and Operation of |
3 | | Pedestrian Facilities;
|
4 | | (5) Public Rights-of-Way Accessibility Guidelines; or
|
5 | | (6) other relevant State, federal, or local |
6 | | guidelines.
|
7 | | (e) The Department may provide assistance to and coordinate |
8 | | with local and regional agencies in developing and implementing |
9 | | complementary Complete Streets Initiative policies. In the |
10 | | development of projects within municipal boundaries, the |
11 | | Department and the municipality shall share expertise in |
12 | | multimodal transportation planning.

13 | | (f) The Department shall modify its procedures, documents, |
14 | | training systems, and performance measures in a timely manner |
15 | | to ensure that the needs of all users of the transportation |
16 | | system are included in all phases of all projects. The |
17 | | Department shall create an implementation plan, including a |
18 | | schedule and a public, local, or regional government outreach |
19 | | plan, in consultation with the Advisory Board.

20 | | (g) The provisions of subsections (c) and (d) concerning |
21 | | facilities shall not be required if the Department determines, |
22 | | with respect to a highway, road, or street, that:
|
23 | | (1) use of the transportation facility by pedestrians, |
24 | | bicyclists, or other users is prohibited by law;
|
25 | | (2) the cost of new accommodation would be excessively |
26 | | disproportionate to the need or probable use; or
|

1 | | (3) there is a demonstrated absence of future need as |
2 | | determined by factors, including current and future land |
3 | | use, current and projected user volumes, population |
4 | | density, and crash data.

5 | | (h) The Department shall consult local and regional plans |
6 | | and leaders in assessing any further necessary exceptions to |
7 | | the provisions of this Section.
|
8 | | (i) Documentation on any granted exemption shall be made |
9 | | publicly available and shared with the Advisory Board.
|
10 | | (j) This Section applies to transportation projects for |
11 | | which a preliminary design has been completed on or after |
12 | | September 1, 2017. |
13 | | Section 15. Advisory Board.
|
14 | | (a) There is created the Complete Streets Advisory Board |
15 | | within the Department for the following purposes:
|
16 | | (1) providing education and advice to counties, |
17 | | municipalities, interest groups, and the public concerning |
18 | | safety, access, and mobility across the various modes of |
19 | | transportation; and
|
20 | | (2) making recommendations to the Department on |
21 | | restructuring procedures, updating design guidance, |
22 | | providing education opportunities to employees, and |
23 | | establishing new measures to track success in multimodal |
24 | | planning and design.

25 | | (b) The members of the Advisory Board shall be appointed by |

1 | | the Governor and shall include the following members:
|
2 | | (1) one representative from the Department;
|
3 | | (2) one representative from the Illinois Department of |
4 | | Health;
|
5 | | (3) one licensed engineer with expertise in |
6 | | transportation;
|
7 | | (4) one representative from the Illinois Chapter of the |
8 | | American Planning Association;
|
9 | | (5) one representative from the Illinois County |
10 | | Association;
|
11 | | (6) one representative from the Illinois Municipal |
12 | | League;
|
13 | | (7) one representative from the Illinois Office of |
14 | | AARP;
|
15 | | (8) one representative from an organization advocating |
16 | | bicycling as a mode of travel;
|
17 | | (9) one representative from an organization advocating |
18 | | walking as a mode of travel;
|
19 | | (10) one representative from an organization |
20 | | representing persons with disabilities;
|
21 | | (11) one representative from an automobile or trucking |
22 | | transport organization; |
23 | | (12) one representative from an organization |
24 | | advocating on behalf of children; and |
25 | | (13) any other interested party as determined by the |
26 | | Governor.

1 | | (c) Members of the Advisory Board shall be appointed to a |
2 | | term of 4 years and shall serve without compensation. |
3 | | (d) The Advisory Board, in coordination with a |
4 | | representative or representatives of the Department, shall |
5 | | prepare a report on the status of the implementation of the |
6 | | Complete Streets Initiative as outlined in Section 10 of this |
7 | | Act. The report shall include the following information:

8 | | (1) a summary of specific actions taken by the |
9 | | Department in the preceding year to improve safety, access, |
10 | | and mobility of roadways for all users;
|
11 | | (2) any identified statutory recommendations to |
12 | | facilitate implementation of the Complete Streets |
13 | | Initiative;
|
14 | | (3) modifications made to or recommended for |
15 | | protocols, guidance, standards, or other requirements to |
16 | | facilitate implementation of the Complete Streets |
17 | | Initiative;
|
18 | | (4) the status of the development of multimodal |
19 | | performance indicators;
|
20 | | (5) information collected from agencies on the |
21 | | percentage of trips made by foot, bicycle, and public |
22 | | transportation, together with the target level of the use |
23 | | of these modes;
|
24 | | (6) crash statistics by mode, age, type, location, and |
25 | | other relevant factors; and
|
26 | | (7) other related information that may be requested by |
