2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Environmental Protection Act is amended by |
5 | | adding Sections 13.9 and 21.7 as follows: |
6 | | (415 ILCS 5/13.9 new) |
7 | | Sec. 13.9. Mahomet Aquifer natural gas storage study. |
8 | | (a) Subject to appropriation, the Prairie Research |
9 | | Institute shall: |
10 | | (1) use remote sensing technologies, such as |
11 | | helicopter-based time domain electromagnetics, |
12 | | post-processing methods, and geologic modeling software, |
13 | | to examine, characterize, and prepare three-dimensional |
14 | | models of the unconsolidated geologic materials overlying |
15 | | any underground natural gas storage facility located |
16 | | within the boundaries of the Mahomet Aquifer; and |
17 | | (2) to the extent possible, identify within those |
18 | | unconsolidated geologic materials potential structures and |
19 | | migration pathways for natural gas that may be released |
20 | | from the underground natural gas storage facility. |
21 | | (b) For purposes of this Section, "underground natural gas |
22 | | storage facility" has the meaning provided in Section 5 of the |
23 | | Illinois Underground Natural Gas Storage Safety Act. |

2 | | Sec. 21.7. Landfills. |
3 | | (a) The purpose of this Section is to enact legislative |
4 | | recommendations provided by the Mahomet Aquifer Task Force, |
5 | | established under Public Act 100-403. The Task Force identified |
6 | | capped but unregulated or underregulated landfills that |
7 | | overlie the Mahomet Aquifer as potentially hazardous to |
8 | | valuable groundwater resources. These unregulated or |
9 | | underregulated landfills generally began accepting waste for |
10 | | disposal sometime prior to 1973. |
11 | | (b) The Agency shall prioritize unregulated or |
12 | | underregulated landfills that overlie the Mahomet Aquifer for |
13 | | inspection. The following factors shall be considered: |
14 | | (1) the presence of, and depth to, any aquifer with |
15 | | potential potable use; |
16 | | (2) whether the landfill has an engineered liner |
17 | | system; |
18 | | (3) whether the landfill has an active groundwater |
19 | | monitoring system; |
20 | | (4) whether waste disposal occurred within the |
21 | | 100-year floodplain; and |
22 | | (5) landfills within the setback zone of any potable |
23 | | water supply well. |
24 | | (c) Subject to appropriation, the Agency shall use existing |
25 | | information available from State and federal agencies, such as |

1 | | the Prairie Research Institute, the Department of Natural |
2 | | Resources, the Illinois Emergency Management Agency, the |
3 | | Federal Emergency Management Agency, and the Natural Resources |
4 | | Conservation Service, to identify unknown, unregulated, or |
5 | | underregulated waste disposal sites that overlie the Mahomet |
6 | | Aquifer that may pose a threat to surface water or groundwater |
7 | | resources. |
8 | | (d) Subject to appropriation, for those landfills |
9 | | prioritized for response action following inspection and |
10 | | investigation, the Agency shall use its own data, along with |
11 | | data from municipalities, counties, solid waste management |
12 | | associations, companies, corporations, and individuals, to |
13 | | archive information about the landfills, including their |
14 | | ownership, operational details, and waste disposal history. |
15 | | Section 10. The Illinois Groundwater Protection Act is |
16 | | amended by adding Section 10 as follows: |
17 | | (415 ILCS 55/10 new) |
18 | | Sec. 10. Pekin Metro Landfill; pilot projects. |
19 | | (a) Subject to appropriation, the Agency shall design and |
20 | | implement up to 2 pilot studies of landfills that overlie the |
21 | | Mahomet Aquifer to identify threats to surface and groundwater |
22 | | resources that are posed by the landfills. One of the pilot |
23 | | projects shall be conducted at the Pekin Metro Landfill in |
24 | | Tazewell County. In conducting the pilot projects, the Agency |

1 | | shall: |
2 | | (1) inspect and identify potential and current |
3 | | contamination threats to the water quality of aquifers in |
4 | | the same watershed as the landfill (for the Pekin Metro |
5 | | Landfill, the Mahomet Aquifer); |
6 | | (2) use geographic information systems and remote |
7 | | sensing technology to track defects, structures, |
8 | | appliances, and wells for routine inspection and |
9 | | sustainable management; |
10 | | (3) install or repair groundwater monitoring |
11 | | mechanisms necessary to identify whether contaminants from |
12 | | the landfill are affecting water quality in the Mahomet |
13 | | Aquifer; and |
14 | | (4) identify and provide cost estimates for any |
15 | | additional response actions necessary or appropriate to |
16 | | reduce or minimize potential threats to human health and |
17 | | the environment resulting from current landfill |
18 | | conditions. |
19 | | (b) Following the completion of the pilot project response |
20 | | actions, the Agency shall: |
21 | | (1) evaluate, in consultation with the Prairie |
22 | | Research Institute, the use of aerial photography and other |
23 | | remote sensing technologies, such as Light Detection and |
24 | | Ranging (LiDAR), to identify land erosion, landslides, |
25 | | barren areas, leachate seeps, vegetation, and other |
26 | | relevant surface and subsurface features of landfills to |
