| 1 | | AN ACT concerning elections.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Election Code is amended by changing |
| 5 | | Sections 7-42 and 17-15 as follows:
|

| 7 | | Sec. 7-42.
|
| 8 | | (a) Any person entitled to vote at such primary shall, on |
| 9 | | the day of
such primary, with the consent of his employer be |
| 10 | | entitled to absent
himself from any service or employment in |
| 11 | | which he is then engaged or
employed for a period of two hours |
| 12 | | between the time of opening and closing
the polls. The employer |
| 13 | | may specify the hours during which said employe may
absent |
| 14 | | himself.

| 15 | | (b) Beginning the 15th day before the primary election or |
| 16 | | on the day of the primary election, any student entitled to |
| 17 | | vote at such primary shall be entitled to be absent from school |
| 18 | | for a period of 2 hours during the school day in order to vote. |
| 19 | | The school may specify the hours during which the eligible |
| 20 | | student may be absent. A student who is absent from school |
| 21 | | under this subsection (b) is not considered absent for the |
| 22 | | purpose of calculating enrollment under Section 18-8.15 of the |
| 23 | | School Code. |

| 4 | | (a) Any person entitled to vote at a general or special |

at any election at which propositions are submitted |
| 6 | | to a popular vote in
this State, shall, on the day of such |
| 7 | | election, be entitled to absent
himself from any services or |
| 8 | | employment in which he is then engaged or
employed, for a |
| 9 | | period of 2 hours between the time of opening and closing
the |
| 10 | | polls; and such voter shall not because of so absenting himself |
| 11 | | be
liable to any penalty; Provided, however, that application |
| 12 | | for such leave
of absence shall be made prior to the day of |
| 13 | | election. The employer may
specify the hours during which said |
| 14 | | employee may absent himself as
aforesaid, except that the |
| 15 | | employer must permit a 2-hour absence during working hours if |
| 16 | | the employee's working hours begin less than 2 hours after the |
| 17 | | opening of the polls and end less than 2 hours before the |
| 18 | | closing of the polls. No person or corporation shall refuse to |
| 19 | | an employee the
privilege hereby conferred, nor shall subject |
| 20 | | an employee to a penalty, including a reduction in compensation |
| 21 | | due to an absence under this Section,
because of the exercise |
| 22 | | of such privilege, nor shall directly or indirectly
violate the |
| 23 | | provisions of this Section.

A student who is absent from |
