SYNOPSIS AS INTRODUCED:

    Amends the Election Code. Provides that a student entitled to vote in a primary, general, or special election or at any election at which propositions are submitted to a popular vote in the State, with consent from his or her school, is entitled to absent himself or herself for 2 hours to vote and that the school may specify the hours in which the student may absent himself or herself.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Sections 7-42 and 17-15 as follows:
 
6    (10 ILCS 5/7-42)  (from Ch. 46, par. 7-42)
7    Sec. 7-42. Any person entitled to vote at such primary
8shall, on the day of such primary, with the consent of his
9employer or school be entitled to absent himself from any
10service or employment in which he is then engaged or employed
11for a period of two hours between the time of opening and
12closing the polls. The employer or school may specify the hours
13during which said employe or student may absent himself.

16    Sec. 17-15. Any person entitled to vote at a general or
17special election or at any election at which propositions are
18submitted to a popular vote in this State, shall, on the day of
19such election, be entitled to absent himself from any services
20or employment in which he is then engaged or employed, for a
21period of 2 hours between the time of opening and closing the
22polls; and such voter shall not because of so absenting himself

1be liable to any penalty; Provided, however, that application
2for such leave of absence shall be made prior to the day of
3election. The employer or school may specify the hours during
4which said employee or student may absent himself as aforesaid,
5except that the employer or school must permit a 2-hour absence
6during working or school hours if the employee's working hours
7or the school's hours begin less than 2 hours after the opening
8of the polls and end less than 2 hours before the closing of
9the polls. No person, or corporation, or school shall refuse to
10an employee or student the privilege hereby conferred, nor
11shall subject an employee or student to a penalty, including a
12reduction in compensation due to an absence under this Section,
13because of the exercise of such privilege, nor shall directly
14or indirectly violate the provisions of this Section.
