2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Raffles and Poker Runs Act is amended by |
5 | | changing Sections 2 and 9 as follows:
|

7 | | Sec. 2. Licensing. |
8 | | (a) The governing body of any county or municipality
within |
9 | | this State may establish a system for the licensing of |
10 | | organizations
to operate raffles. The governing bodies of a |
11 | | county and one or more
municipalities may, pursuant to a |
12 | | written contract, jointly establish a
system for the licensing |
13 | | of organizations to operate raffles within any
area of |
14 | | contiguous territory not contained within the corporate limits |
15 | | of a
municipality which is not a party to such contract. The |
16 | | governing bodies
of two or more adjacent counties or two or |
17 | | more adjacent municipalities
located within a county may, |
18 | | pursuant to a written contract, jointly
establish a system for |
19 | | the licensing of organizations to operate raffles
within the |
20 | | corporate limits of such counties or municipalities. The
|
21 | | licensing authority may establish special categories of |
22 | | licenses and
promulgate rules relating to the various |
23 | | categories. The licensing system
shall provide for limitations |

1 | | upon (1) the aggregate retail value of all
prizes or |
2 | | merchandise awarded by a licensee in a single raffle, (2) the
|
3 | | maximum retail value of each prize awarded by a licensee in a |
4 | | single raffle,
(3) the maximum price which may be charged for |
5 | | each raffle chance issued
or sold and (4) the maximum number of |
6 | | days during which chances may be issued
or sold. The licensing |
7 | | system may include a fee for each license in an
amount to be |
8 | | determined by the local governing body. Licenses issued |
9 | | pursuant
to this Act shall be valid for one raffle or for a |
10 | | specified number of
raffles to be conducted during a specified |
11 | | period not to exceed one year
and may be suspended or revoked
|
12 | | for any violation of this Act. A local governing body shall act |
13 | | on a license
application within 30 days from the date of |
14 | | application. Nothing in this
Act shall be construed to prohibit |
15 | | a county or municipality from adopting
rules or ordinances for |
16 | | the operation of raffles that are more restrictive
than |
17 | | provided for in this Act. Except for raffles organized by law |
18 | | enforcement agencies and statewide associations that represent |
19 | | law enforcement officials as provided in Section 9 of this Act, |
20 | | the governing body of a municipality may
authorize the sale of |
21 | | raffle chances only within the borders of the
municipality. |
22 | | Except for raffles organized by law enforcement agencies and |
23 | | statewide associations that represent law enforcement |
24 | | officials as provided in Section 9, the governing body of the |
25 | | county may authorize the sale of
raffle chances only in those |
26 | | areas which are both within the borders of the
county and |

1 | | outside the borders of any municipality.

2 | | (a-5) The governing body of Cook County may and any other |
3 | | county within this State shall establish a system for the |
4 | | licensing of organizations to operate poker runs. The governing |
5 | | bodies of 2 or more adjacent counties may, pursuant to a |
6 | | written contract, jointly establish a system for the licensing |
7 | | of organizations to operate poker runs within the corporate |
8 | | limits of such counties. The licensing authority may establish |
9 | | special categories of licenses and adopt rules relating to the |
10 | | various categories. The licensing system may include a fee not |
11 | | to exceed $25 for each license. Licenses issued pursuant to |
12 | | this Act shall be valid for one poker run or for a specified |
13 | | number of poker runs to be conducted during a specified period |
14 | | not to exceed one year and may be suspended or revoked for any |
15 | | violation of this Act. A local governing body shall act on a |
16 | | license application within 30 days after the date of |
17 | | application. |
18 | | (b) Raffle licenses shall be issued only to bona fide |
19 | | religious, charitable,
labor, business, fraternal, educational |
20 | | or veterans' organizations that
operate without profit to their |
21 | | members and which have been in existence
continuously for a |
22 | | period of 5 years immediately before making application
for a |
23 | | raffle license and which have had during that entire 5-year |
24 | | period a bona
fide membership engaged in carrying out their |
25 | | objects, or to a non-profit
fundraising organization that the |
26 | | licensing authority determines is
organized for the sole |

1 | | purpose of providing financial assistance to an
identified |
2 | | individual or group of individuals suffering extreme financial
|
3 | | hardship as the result of an illness, disability, accident or |
4 | | disaster, as well as law enforcement agencies and statewide |
5 | | associations that represent law enforcement officials as |
6 | | provided for in Section 9 of this Act. Poker run licenses shall |
7 | | be issued only to bona fide religious, charitable, labor, |
8 | | business, fraternal, educational, veterans', or other bona |
9 | | fide not-for-profit organizations that operate without profit |
10 | | to their members and which have been in existence continuously |
11 | | for a period of 5 years immediately before making application |
12 | | for a poker run license and which have had during that entire |
13 | | 5-year period a bona fide membership engaged in carrying out |
14 | | their objects. Licenses for poker runs shall be issued for the |
15 | | following purposes: (i) providing financial assistance to an |
16 | | identified individual or group of individuals suffering |
17 | | extreme financial hardship as the result of an illness, |
18 | | disability, accident, or disaster or (ii) to maintain the |
19 | | financial stability of the organization. A licensing authority |
20 | | may waive the 5-year requirement under this subsection (b) for |
21 | | a bona fide religious, charitable, labor, business, fraternal, |
22 | | educational, or veterans' organization that applies for a |
23 | | license to conduct a poker run if the organization is a local |
24 | | organization that is affiliated with and chartered by a |
25 | | national or State organization that meets the 5-year |
26 | | requirement.

1 | | For purposes of this Act, the following definitions apply. |
2 | | Non-profit:
An organization or institution organized and |
3 | | conducted on a not-for-profit
basis with no personal profit |
4 | | inuring to any one as a result of the operation.
Charitable: An |
5 | | organization or institution organized and operated to benefit
|
6 | | an indefinite number of the public. The service rendered to |
7 | | those eligible
for benefits must also confer some benefit on |
8 | | the public. Educational:
An organization or institution |
9 | | organized and operated to provide systematic
instruction in |
10 | | useful branches of learning by methods common to schools
and |
11 | | institutions of learning which compare favorably in their scope |
12 | | and
intensity with the course of study presented in |
13 | | tax-supported schools.
Religious: Any church, congregation, |
14 | | society, or organization founded for
the purpose of religious |
15 | | worship. Fraternal: An organization of persons
having a common |
16 | | interest, the primary interest of which is to both promote
the |
17 | | welfare of its members and to provide assistance to the general |
18 | | public
in such a way as to lessen the burdens of government by |
19 | | caring for those
that otherwise would be cared for by the |
20 | | government. Veterans: An organization
or association comprised |
21 | | of members of which substantially all are individuals
who are |
22 | | veterans or spouses, widows, or widowers of veterans, the |
23 | | primary
purpose of which is to promote the welfare of its |
24 | | members and to provide
assistance to the general public in such |
25 | | a way as to confer a public benefit.
Labor: An organization |
26 | | composed of workers organized with the objective
of betterment |

1 | | of the conditions of those engaged in such pursuit and the
|
2 | | development of a higher degree of efficiency in their |
3 | | respective occupations.
Business: A voluntary organization |
4 | | composed of individuals and businesses
who have joined together |
5 | | to advance the commercial, financial, industrial
and civic |
6 | | interests of a community.
|
7 | | (c) Poker runs shall be licensed by the county with |
8 | | jurisdiction over the key location. The license granted by the |
9 | | key location shall cover the entire poker run, including |
10 | | locations other than the key location. Each license issued |
11 | | shall include the name and address of each predetermined |
12 | | location. |

16 | | Sec. 9. Raffles by law enforcement agencies and statewide |
17 | | associations that represent law enforcement officials. |
18 | | (a) As used in this Section: |
19 | | "Key location" means the location where the raffle |
20 | | organized by a law enforcement agency or an a statewide |
21 | | association that represents law enforcement officials is |
22 | | conducted and the prize or prizes are awarded. |
23 | | "Law enforcement agency" means an agency of this State or |
24 | | unit of local government which is vested by law or ordinance |
25 | | with the duty to maintain public order and to enforce criminal |

1 | | laws or ordinances. |
2 | | (b) Notwithstanding the other provisions of this Act, law |
3 | | enforcement agencies and statewide associations that represent |
4 | | law enforcement officials may organize raffles under this Act. |
5 | | Raffles organized by a law enforcement agency or an a statewide |
6 | | association that represents law enforcement officials must |
7 | | only be licensed by the governing body of the county or |
8 | | municipality in which the key location for that raffle is |
9 | | located, even if raffle tickets are sold beyond the borders of |
10 | | that governing body of the county or municipality. A raffle |
11 | | organized by a law enforcement agency or an a statewide |
12 | | association that represents law enforcement officials must |
13 | | abide by any restrictions established pursuant to subsection |
14 | | (a) of Section 2 of this Act by the governing body of the |
15 | | county or municipality in which the key location is located.
