AMENDMENT TO SENATE BILL 1793

2    AMENDMENT NO. ______. Amend Senate Bill 1793 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. Findings. The General Assembly finds that the
5positions of fire chief and paramedic chief in the Chicago Fire
6Department are positions that require the knowledge and skill
7of experienced members of the Chicago Fire Department.
8Furthermore, the General Assembly finds that the positions of
9fire chief and paramedic chief are positions in which persons
10holding the fire chief and paramedic chief rank take command
11of, or otherwise give orders to, their subordinates at
12potentially dangerous or life-threatening incidents and
13activities.
 
14    Section 10. The Illinois Municipal Code is amended by
15adding Section 10-1-7.4 as follows:

1    (65 ILCS 5/10-1-7.4 new)
2    Sec. 10-1-7.4. Temporary fire chief and paramedic chief
3advisory board.
4    (a) As used in this Section, "fire chief" or "paramedic
5chief" means an individual temporarily appointed by the Fire
6Commissioner to have direct supervisory authority over sworn
7firefighters, paramedics, or emergency medical technicians of
8the Chicago Fire Department.
9    (b) A advisory board is created in the Chicago Fire
10Department to recommend to the Fire Commissioner of the Chicago
11Fire Department the best candidates for each position of fire
12chief or paramedic chief with a goal of a diverse fire
13department that reflects the diversity of the City of Chicago.
14The advisory board shall be comprised of 8 members appointed by
15the Fire Commissioner, or his or her designee, 4 of whom must
16be, at the time of appointment and during all times while
17serving on the advisory board: (i) a member of an organization
18representing the interest of firefighters and paramedics of the
19Chicago Fire Department; and (ii) elected at large by members
20of that organization to the organization's executive board. The
21Fire Commissioner shall make his or her initial appointments to
22the advisory board no later than 60 days after the effective
23date of this amendatory Act of the 101st General Assembly. The
24advisory board shall meet no later than 90 days after the
25effective date of this amendatory Act of the 101st General
26Assembly to elect a chair and vice-chair. Beginning June 1,

12020, and every June 1 thereafter, members shall be appointed
2or reappointed to one-year terms and each newly-appointed
3advisory board shall meet no later than July 1 of each year to
4elect a chair and vice-chair.
5    (c) The Fire Commissioner shall provide written notice to
6the advisory board each time the Fire Commissioner will need to
7make an appointment of a fire chief or paramedic chief. The
8Fire Commissioner must provide with the written notice to the
9advisory board a list of candidates for each position that he
10or she will need to make an appointment, including which
11candidates meet the criteria under subsection (d). The advisory
12board shall meet no later than 30 days after receipt of each
13written notice from the Fire Commissioner and shall issue a
14recommendation or recommendations to the Fire Commissioner no
15later than 15 days after the initial meeting. In order to be
16recommended for the position of fire chief or paramedic chief,
175 members of the advisory board must agree to the
18recommendation.
19    (d) The Fire Commissioner may appoint a fire chief or
20paramedic chief after the advisory board has issued its
21recommendation under subsection (c). An individual appointed
22fire chief or paramedic chief by the Fire Commissioner must
23meet the following criteria:
24        (1) is an active member of the Chicago Fire Department
25    who is not receiving any type of pension from the Firemen's
26    Annuity and Benefit Fund of Chicago;

1        (2) has 10 years of creditable service time with the
2    Chicago Fire Department;
3        (3) has held the career service rank of battalion chief
4    or field chief with the Chicago Fire Department prior to
5    his or her appointment to the rank of fire chief or
6    paramedic chief; and
7        (4) does not exceed the maximum age set forth in the
8    ordinances of the City of Chicago that govern active sworn
9    members of the Chicago Fire Department.
10    However, the Fire Commissioner may appoint any individual
11recommended by the advisory board under subsection (c) even if
12they do not meet the criteria in this subsection.
13    (e) The advisory board shall adopt all necessary rules and
14procedures it finds necessary to carry out the process of
15recommending qualified candidates. The City of Chicago shall
16provide administrative and other support to the advisory board.
17    (f) The City of Chicago may not regulate the advisory board
18or regulate appointments of fire chiefs or paramedic chiefs in
19the Chicago Fire Department in a manner inconsistent with this
20Section. This Section is a limitation under subsection (i) of
21Section 6 of Article VII of the Illinois Constitution on the
22concurrent exercise by home rule units of powers and functions
23exercised by the State.
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
