2 | | Sec. 10-1-7.4. Temporary fire chief and paramedic chief |
3 | | advisory board. |
4 | | (a) As used in this Section, "fire chief" or "paramedic |
5 | | chief" means an individual temporarily appointed by the Fire |
6 | | Commissioner to have direct supervisory authority over sworn |
7 | | firefighters, paramedics, or emergency medical technicians of |
8 | | the Chicago Fire Department. |
9 | | (b) A advisory board is created in the Chicago Fire |
10 | | Department to recommend to the Fire Commissioner of the Chicago |
11 | | Fire Department the best candidates for each position of fire |
12 | | chief or paramedic chief. The advisory board shall be comprised |
13 | | of 8 members appointed by the Fire Commissioner, or his or her |
14 | | designee, 4 of whom must be, at the time of appointment and |
15 | | during all times while serving on the advisory board: (i) a |
16 | | member of an organization representing the interest of |
17 | | firefighters and paramedics of the Chicago Fire Department; and |
18 | | (ii) elected at large by members of that organization to the |
19 | | organization's executive board. The Fire Commissioner shall |
20 | | make his or her initial appointments to the advisory board no |
21 | | later than 60 days after the effective date of this amendatory |
22 | | Act of the 101st General Assembly. The advisory board shall |
23 | | meet no later than 90 days after the effective date of this |
24 | | amendatory Act of the 101st General Assembly to elect a chair |
25 | | and vice-chair. Beginning June 1, 2020, and every June 1 |
26 | | thereafter, members shall be appointed or reappointed to |

1 | | one-year terms and each newly-appointed advisory board shall |
2 | | meet no later than July 1 of each year to elect a chair and |
3 | | vice-chair. |
4 | | (c) The Fire Commissioner shall provide written notice to |
5 | | the advisory board each time the Fire Commissioner will need to |
6 | | make an appointment of a fire chief or paramedic chief. The |
7 | | Fire Commissioner must provide with the written notice to the |
8 | | advisory board a list of candidates for each position that he |
9 | | or she will need to make an appointment, including which |
10 | | candidates meet the criteria under subsection (d). The advisory |
11 | | board shall meet no later than 30 days after receipt of each |
12 | | written notice from the Fire Commissioner and shall issue a |
13 | | recommendation or recommendations to the Fire Commissioner no |
14 | | later than 15 days after the initial meeting. In order to be |
15 | | recommended for the position of fire chief or paramedic chief, |
16 | | 5 members of the advisory board must agree to the |
17 | | recommendation. |
18 | | (d) The Fire Commissioner may appoint a fire chief or |
19 | | paramedic chief after the advisory board has issued its |
20 | | recommendation under subsection (c). An individual appointed |
21 | | fire chief or paramedic chief by the Fire Commissioner should |
22 | | meet the following criteria: |
23 | | (1) is an active member of the Chicago Fire Department |
24 | | who is not receiving any type of pension from the Firemen's |
25 | | Annuity and Benefit Fund of Chicago; |
26 | | (2) has 10 years of creditable service time with the |

1 | | Chicago Fire Department; |
2 | | (3) has held the career service rank of battalion chief |
3 | | or field chief with the Chicago Fire Department prior to |
4 | | his or her appointment to the rank of fire chief or |
5 | | paramedic chief; and |
6 | | (4) does not exceed the maximum age set forth in the |
7 | | ordinances of the City of Chicago that govern active sworn |
8 | | members of the Chicago Fire Department. |
9 | | However, the Fire Commissioner may appoint any individual |
10 | | recommended by the advisory board under subsection (c) even if |
11 | | they do not meet the criteria in this subsection. |
12 | | (e) The advisory board shall adopt all necessary rules and |
13 | | procedures it finds necessary to carry out the process of |
14 | | recommending qualified candidates. The City of Chicago shall |
15 | | provide administrative and other support to the advisory board. |
16 | | (f) The City of Chicago may not regulate the advisory board |
17 | | or regulate appointments of fire chiefs or paramedic chiefs in |
18 | | the Chicago Fire Department in a manner inconsistent with this |
19 | | Section. This Section is a limitation under subsection (i) of |
20 | | Section 6 of Article VII of the Illinois Constitution on the |
21 | | concurrent exercise by home rule units of powers and functions |
22 | | exercised by the State.

23 | | Section 99. Effective date. This Act takes effect upon |
24 | | becoming law.".
