AMENDMENT TO SENATE BILL 1792

2    AMENDMENT NO. ______. Amend Senate Bill 1792, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
43 as follows:
 
5by deleting line 23 on page 5 through line 13 on page 53; and
 
6on page 57, line 8, by replacing "A" with "If a loan exceeds
7the rate permitted by Section 15-5-5, a"; and
 
8on page 76, by replacing lines 18 through 25 with the
9following:
 
10    "(d) (g) The certified database provider shall indemnify
11the licensee against all claims and actions arising from
12illegal or willful or wanton acts on the part of the certified
13database provider. The certified database provider may charge a
14fee not to exceed $1 for each loan entered into the certified

1database under subsection (d) of this Section. The database
2provider shall not charge any additional fees or charges to the
3licensee."; and
 
4on page 124, by replacing lines 1 through 24 with the
5following:
 
6    "Section 20-5. The Department of Commerce and Economic
7Opportunity Law of the Civil Administrative Code of Illinois is
8amended by adding Section 605-1055 as follows:
 
9    (20 ILCS 605/605-1055 new)
10    Sec. 605-1055. Personal care products industry supplier
11disparity study.
12    (a) The Department shall compile and publish a disparity
13study by December 31, 2022 that: (1) evaluates whether there
14exists intentional discrimination at the supplier or
15distribution level for retailers of beauty products,
16cosmetics, hair care supplies, and personal care products in
17the State of Illinois; and (2) if so, evaluates the impact of
18such discrimination on the State and includes recommendations
19for reducing or eliminating any barriers to entry to those
20wishing to establish businesses at the retail level involving
21such products. The Department shall forward a copy of its
22findings and recommendations to the General Assembly and
23Governor.

1    (b) The Department may compile, collect, or otherwise
2gather data necessary for the administration of this Section
3and to carry out the Department's duty relating to the
4recommendation of policy changes. The Department shall compile
5all of the data into a single report, submit the report to the
6Governor and the General Assembly, and publish the report on
7its website.
8    (c) This Section is repealed on January 1, 2024.

10    Section 99-99. Effective date. This Act takes effect upon
11becoming law.".
