AMENDMENT TO SENATE BILL 1641

2    AMENDMENT NO. ______. Amend Senate Bill 1641 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5adding Sections 12-4.13b and 12-4.13c as follows:
 
6    (305 ILCS 5/12-4.13b)
7    Sec. 12-4.13b. College student eligibility for
8supplemental nutrition assistance benefits.
9    (a) For the purposes of Section 273.5(b)(11)(ii) of Title 7
10of the Code of Federal Regulations, a career and technical an
11educational program offered at a community college and approved
12by the Illinois Community College Board under the Carl D.
13Perkins Career and Technical Education Improvement Act of 2006
14(Public Law 109-270) that could be a component of a SNAP
15Employment and Training (E&T) program, as identified by the
16Department of Human Services, shall be considered an employment

1and training program under Section 273.7 of Title 7 of the Code
2of Federal Regulations, unless prohibited by federal law.
3    (b) The Department of Human Services, in consultation with
4representatives of the Illinois Community College Board, the
5Illinois Student Assistance Commission ISAC, the Illinois
6Workforce Innovation Board Investment Board, and advocates for
7students and SNAP recipients, shall establish a protocol to
8identify and verify all potential exemptions to the eligibility
9rule described in Section 273.5(a) of Title 7 of the Code of
10Federal Regulations, and to identify and verify a student's
11participation in educational programs, including, but not
12limited to, self-initiated placements, that would exempt a
13student from the eligibility rule described in Section 273.5(a)
14of Title 7 of the Code of Federal Regulations. To the extent
15possible, this consultation shall take place through existing
16workgroups convened by the Department of Human Services.
17    (c) If the United States Department of Agriculture requires
18federal approval of the exemption designation established
19pursuant to subsection (a) and the protocol established
20pursuant to subsection (b), the Department of Human Services
21shall seek and obtain that approval before publishing the
22guidance or regulation required by subsection (e).
23    (d)(1) This Section does not require the Department of
24Human Services to offer a particular component, support
25services, or workers' compensation to a college student found
26eligible for an exemption pursuant to this Section.

1    (2) This Section does not restrict or require the use of
2federal funds for the financing of SNAP E&T programs.
3    (3) This Section does not require an institution of higher
4education to verify eligibility for SNAP.
5    (e) The Department of Human Services shall adopt any rules
6necessary to implement the provisions of subsections (a), (b),
7(c), and (d).

10    Sec. 12-4.13c. SNAP eligibility notification; college
11students.
12    (a) To complement student financial assistance programs
13and to enhance their effectiveness by more fully addressing the
14costs of attendance for students with financial needs, the
15Illinois Student Assistance Commission (ISAC) shall identify
16and flag college students who are potentially eligible to
17receive Supplemental Nutrition Assistance Program (SNAP)
18benefits. The factors to be used to determine potential SNAP
19eligibility shall be prescribed by ISAC in consultation with
20the Department of Human Services, but at a minimum shall
21include income information reported on a college student's Free
22Application for Federal Student Aid. ISAC, in consultation with
23the Department of Human Services, shall develop a notice that
24ISAC shall make available electronically to institutions of
25higher education that includes, at a minimum, college student

1SNAP eligibility criteria, the Application for Benefits
2Eligibility's website address, and the Illinois Hunger
3Coalition's Hunger Hotline.
4    (b) Illinois institutions of higher education that
5participate in the Monetary Award Program shall provide the
6notice described in subsection (a) in writing to all students
7who are enrolled or accepted for enrollment and are identified
8by ISAC as potentially SNAP eligible and, if possible, may
9designate a public benefits liaison or single point person to
10assist students in taking the necessary steps to obtain public
11benefits if eligible.
12    (c) ISAC shall adopt any rules necessary to implement the
13provisions of this Section on or before October 1, 2020.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
