AMENDMENT TO SENATE BILL 1568

2    AMENDMENT NO. ______. Amend Senate Bill 1568 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-236 as follows:
 
7    (20 ILCS 2310/2310-236 new)
8    Sec. 2310-236. Form of coroner's report; sudden unexpected
9infant death and sudden infant death syndrome.
10    (a) The Department shall develop and require the use of a
11form by coroners in the case of a death of an infant in which
12the cause of death is sudden unexpected infant death or sudden
13infant death syndrome. The form shall contain, at minimum, the
14following information to be recorded after a preliminary
15investigation:
16        (1) The date and time of death.

1        (2) The county of occurrence and the county of the
2    infant's residence.
3        (3) Relevant demographic details regarding the infant,
4    such as date of birth and gender.
5        (4) Relevant demographic details regarding the parents
6    or caretaker of the infant.
7        (5) Relevant details regarding the circumstances of
8    the death, including, but not limited to, who found the
9    infant, where, and what they did.
10        (6) Relevant details concerning where the infant was
11    placed, by whom, and in what position.
12        (7) Any additional relevant details concerning the
13    sleep environment that the infant was placed in and what
14    environmental factors were present, to the extent that
15    those factors are ascertainable.
16        (8) Relevant details concerning health hazards present
17    in the sleep environment, to the extent that those health
18    hazards are ascertainable.
19        (9) Relevant details concerning the infant's medical
20    history and previous medical issues.
21        (10) Other information the Department may determine to
22    be relevant and conducive to understanding and recording
23    the circumstances of the infant's death.
24    (b) The Department shall publish current information
25concerning sudden unexpected infant death and sudden infant
26death syndrome.

1    (c) At least once every 5 years, the Department shall
2review the form and determine whether updates need to be made
3for effectiveness and relevancy.
 
4    Section 10. The Counties Code is amended by changing
5Section 3-3016 as follows:
 
6    (55 ILCS 5/3-3016)  (from Ch. 34, par. 3-3016)
7    Sec. 3-3016. Sudden unexpected infant death and sudden
8infant death syndrome. Where an infant under one year 2 years
9of age has died suddenly and unexpectedly and the circumstances
10concerning the death are unexplained following investigation,
11an autopsy shall be performed by a physician licensed to
12practice medicine in all of its branches who has special
13training in pathology. When an autopsy is conducted under this
14Section, the parents or guardian of the child shall receive a
15preliminary report of the autopsy within 5 days of the infant's
16death. All suspected sudden unexpected infant death and sudden
17infant death syndrome Sudden Infant Death Syndrome cases shall
18be reported to the Statewide Sudden Unexpected Infant Death
19Syndrome Program within 72 hours.
20    Death certificates shall list the cause of death as sudden
21unexpected infant death or sudden infant death syndrome Sudden
22Infant Death Syndrome where this finding is medically justified
23pursuant to the rules and regulations of the Department of
24Public Health. Copies of death certificates which list the

1cause of death of infants under one year 2 years of age as
2sudden unexpected infant death or sudden infant death syndrome
3Sudden Infant Death Syndrome shall be forwarded to the
4Department of Public Health within 30 days of the death with a
5report which shall include an autopsy report, epidemiological
6data required by the Department and other pertinent data.
