1    AN ACT concerning education.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The School Code is amended  by adding Sections 
52-3.176, 10-20.69, and  34-18.61 as follows:
 
6    (105 ILCS 5/2-3.176 new)
7    Sec. 2-3.176. Sexual assault data. The State Board of 
8Education shall post on its website for each school year the 
9total number of incidents reported under Sections 10-20.69 and 
1034-18.61 of this Code statewide and in each school district. 
11The State Board shall also report the data annually to the 
12General Assembly no later than September 1 of each year. 
 
13    (105 ILCS 5/10-20.69 new)
14    Sec. 10-20.69. Attacks on students; sexual assault.
15    (a) In this Section, "sexual assault" means any act of 
16nonconsensual sexual conduct or sexual penetration, as defined 
17under Section 11-0.1 of the Criminal Code of 2012, including, 
18but not limited to, acts prohibited under Sections 11-1.20 
19through 11-1.60 of the Criminal Code of 2012.
20    (b) Upon knowledge of an incident of sexual assault  by a 
21student against another student, a school district shall report 
22the incident to the State Board of Education.

2    Sec. 34-18.61. Attacks on students; sexual assault.
3    (a) In this Section, "sexual assault" means any act of 
4nonconsensual sexual conduct or sexual penetration, as defined 
5under Section 11-0.1 of the Criminal Code of 2012, including, 
6but not limited to, acts prohibited under Sections 11-1.20 
7through 11-1.60 of the Criminal Code of 2012.
8    (b) Upon knowledge of an incident of sexual assault by a 
9student against another student, the school district shall 
10report the incident to the State Board of Education.
