SYNOPSIS AS INTRODUCED:
 
20 ILCS 2610/9  from Ch. 121, par. 307.9

    Amends the State Police Act. Provides that preference for the hiring of a Department of State Police officer shall be given to the son, daughter, stepson, stepdaughter, grandson, granddaughter, brother, or sister of a law enforcement officer who was killed in the line of duty. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as the Illinois
5State Police Line of Duty Preference Act of 2019.
 
6    Section 5. The State Police Act is amended by changing
7Section 9 as follows:

9    Sec. 9. Appointment; qualifications.
10    (a) Except as otherwise provided in this Section, the
11appointment of Department of State Police officers shall be
12made from those applicants who have been certified by the Board
13as being qualified for appointment. All persons so appointed
14shall, at the time of their appointment, be not less than 21
15years of age, or 20 years of age and have successfully
16completed 2 years of law enforcement studies at an accredited
17college or university. Any person appointed subsequent to
18successful completion of 2 years of such law enforcement
19studies shall not have power of arrest, nor shall he be
20permitted to carry firearms, until he reaches 21 years of age.
21In addition, all persons so certified for appointment shall be
22of sound mind and body, be of good moral character, be citizens

1of the United States, have no criminal records, possess such
2prerequisites of training, education and experience as the
3Board may from time to time prescribe, and shall be required to
4pass successfully such mental and physical tests and
5examinations as may be prescribed by the Board. Notwithstanding
6any Board rule to the contrary, all persons who meet one of the
7following requirements are deemed to have met the collegiate
8educational requirements:
9        (i) have been honorably discharged and who have been
10    awarded a Southwest Asia Service Medal, Kosovo Campaign
11    Medal, Korean Defense Service Medal, Afghanistan Campaign
12    Medal, Iraq Campaign Medal, or Global War on Terrorism
13    Expeditionary Medal by the United States Armed Forces;
14        (ii) are active members of the Illinois National Guard
15    or a reserve component of the United States Armed Forces
16    and who have been awarded a Southwest Asia Service Medal,
17    Kosovo Campaign Medal, Korean Defense Service Medal,
18    Afghanistan Campaign Medal, Iraq Campaign Medal, or Global
19    War on Terrorism Expeditionary Medal as a result of
20    honorable service during deployment on active duty;
21        (iii) have been honorably discharged who served in a
22    combat mission by proof of hostile fire pay or imminent
23    danger pay during deployment on active duty; or
24        (iv) have at least 3 years of full active and
25    continuous military duty and received an honorable
26    discharge before hiring.

1    Preference shall be given in such appointments to persons
2who have honorably served in the military or naval services of
3the United States or to the son, daughter, stepson,
4stepdaughter, grandson, granddaughter, brother, or sister of a
5law enforcement officer who was killed in the line of duty as
6defined in Section 2 of the Line of Duty Compensation Act. All
7appointees shall serve a probationary period of 12 months from
8the date of appointment and during that period may be
9discharged at the will of the Director. However, the Director
10may in his or her sole discretion extend the probationary
11period of an officer up to an additional 6 months when to do so
12is deemed in the best interest of the Department.
13    (b) Notwithstanding the other provisions of this Act, after
14July 1, 1977 and before July 1, 1980, the Director of State
15Police may appoint and promote not more than 20 persons having
16special qualifications as special agents as he deems necessary
17to carry out the Department's objectives. Any such appointment
18or promotion shall be ratified by the Board.
19    (c) During the 90 days following the effective date of this
20amendatory Act of 1995, the Director of State Police may
21appoint up to 25 persons as State Police officers. These
22appointments shall be made in accordance with the requirements
23of this subsection (c) and any additional criteria that may be
24established by the Director, but are not subject to any other
25requirements of this Act. The Director may specify the initial
26rank for each person appointed under this subsection.

1    All appointments under this subsection (c) shall be made
2from personnel certified by the Board. A person certified by
3the Board and appointed by the Director under this subsection
4must have been employed by the Illinois Commerce Commission on
5November 30, 1994 in a job title subject to the Personnel Code
6and in a position for which the person was eligible to earn
7"eligible creditable service" as a "noncovered employee", as
8those terms are defined in Article 14 of the Illinois Pension
9Code.
10    Persons appointed under this subsection (c) shall
11thereafter be subject to the same requirements and procedures
12as other State police officers. A person appointed under this
13subsection must serve a probationary period of 12 months from
14the date of appointment, during which he or she may be
15discharged at the will of the Director.
16    This subsection (c) does not affect or limit the Director's
17authority to appoint other State Police officers under
18subsection (a) of this Section.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.
