AMENDMENT TO SENATE BILL 986

2    AMENDMENT NO. ______. Amend Senate Bill 986 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Promotion Act is amended by
5changing Section 8b as follows:
 
6    (20 ILCS 665/8b)
7    Sec. 8b. Municipal convention center and sports facility
8attraction grants.
9    (a) Until July 1, 2022, the Department is authorized to
10make grants, subject to appropriation by the General Assembly,
11from the Tourism Promotion Fund to a unit of local government,
12municipal convention center, or convention center authority
13that provides incentives, as defined in subsection (i) of
14Section 3 of this Act, for the purpose of attracting
15conventions, meetings, and trade shows to municipal convention
16centers and attracting sporting events to municipal amateur

1sports facilities. If there is no municipal convention center
2located within a unit of local government, then the Department
3may make grants, subject to appropriation by the General
4Assembly, from the Tourism Promotion Fund to that unit of local
5government for the purpose of attracting conventions,
6meetings, and trade shows to private convention centers located
7in the unit of local government. Grants awarded under this
8Section shall be based on the net proceeds received under the
9Hotel Operators' Occupation Tax Act for the renting, leasing,
10or letting of hotel rooms in the municipality for the month in
11which the convention, meeting, trade show, or sporting event
12occurs. Grants shall not exceed 80% of the incentive amount
13provided by the unit of local government, municipal convention
14center, or convention center authority. Further, in no event
15may the aggregate amount of grants awarded to a single
16municipal convention center, convention center authority, or
17municipal amateur sports facility exceed $200,000 in any
18calendar year. The Department may, by rule, require any other
19provisions it deems necessary in order to protect the State's
20interest in administering this program.
21    (b) No later than May 15 of each year, through May 15,
222022, the unit of local government, municipal convention
23center, or convention center authority shall certify to the
24Department the amounts of funds expended in the previous fiscal
25year to provide qualified incentives; however, in no event may
26the certified amount pursuant to this paragraph exceed $200,000

1for any municipal convention center, convention center
2authority, or municipal amateur sports facility in any calendar
3year. The unit of local government, convention center, or
4convention center authority shall certify (A) the net proceeds
5received under the Hotel Operators' Occupation Tax Act for the
6renting, leasing, or letting of hotel rooms in the municipality
7for the month in which the convention, meeting, or trade show
8occurs and (B) the average of the net proceeds received under
9the Hotel Operators' Occupation Tax Act for the renting,
10leasing, or letting of hotel rooms in the municipality for the
11same month in the 3 immediately preceding years. The unit of
12local government, municipal convention center, or convention
13center authority shall include the incentive amounts as part of
14its regular audit.
15    (b-5) Grants awarded to a unit of local government,
16municipal convention center, or convention center authority
17may be made by the Department of Commerce and Economic
18Opportunity from appropriations for those purposes for any
19fiscal year, without regard to the fact that the qualification
20or obligation may have occurred in a prior fiscal year.
21    (c) The Department shall submit a report, which must be
22provided electronically, on the effectiveness of the program
23established under this Section to the General Assembly no later
24than January 1, 2022.
