AMENDMENT TO SENATE BILL 683

2    AMENDMENT NO. ______. Amend Senate Bill 683 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by changing
5Section 4-20 as follows:
 
6    (35 ILCS 200/4-20)
7    Sec. 4-20. Additional compensation based on performance.
8    (a) Except as provided in subsection (c), any Any assessor
9in counties with less than 3,000,000 but more than 50,000
10inhabitants each year may petition the Department to receive
11additional compensation based on performance. To receive
12additional compensation, the official's assessment
13jurisdiction must meet the following criteria:
14        (1) the median level of assessment must be no more than
15    35 1/3% and no less than 31 1/3% of fair cash value of
16    property in his or her assessment jurisdiction; and

1        (2) the coefficient of dispersion must not be greater
2    than 15%.
3For purposes of this Section, "coefficient of dispersion" means
4the average deviation of all assessments from the median level.
5For purposes of this Section, the number of inhabitants shall
6be determined by the latest federal decennial census. When the
7most recent census shows an increase in inhabitants to over
850,000 or a decrease to 50,000 or fewer, then the assessment
9year used to compute the coefficient of dispersion and the most
10recent year of the 3-year average level of assessments is the
11year that determines qualification for additional
12compensation. The Department will promulgate rules and
13regulations to determine whether an assessor meets these
14criteria.
15    (b) Except as provided in subsection (c), any Any assessor
16in a county of 50,000 or fewer inhabitants may petition the
17Department for consideration to receive additional
18compensation each year based on performance. In order to
19receive the additional compensation, the assessments in the
20official's assessment jurisdiction must meet the following
21criteria: (i) the median level of assessments must be no more
22than 35 1/3% and no less than 31 1/3% of fair cash value of
23property in his or her assessment jurisdiction; and (ii) the
24coefficient of dispersion must not be greater than 40% in 1994,
2538% in 1995, 36% in 1996, 34% in 1997, 32% in 1998, and 30% in
261999 and every year thereafter.

1    (c) With respect to assessors who are elected on or after
2the effective date of this amendatory Act of the 101st General
3Assembly in a qualified county, in lieu of the compensation
4provided in subsections (a) and (b), the township board of any
5township with an assessor who meets the criteria for additional
6compensation set forth in subsection (a) or (b), as applicable,
7may petition the Department for additional funding based on the
8assessor's performance. As used in this subsection, "qualified
9county" means DuPage, Kane, Lake, McHenry, or Will County.
10    (d) Real estate transfer declarations used by the
11Department in annual sales-assessment ratio studies will be
12used to evaluate applications for additional compensation. The
13Department will audit other property to determine if the
14sales-assessment ratio study data is representative of the
15assessment jurisdiction. If the ratio study is found not
16representative, appraisals and other information may be
17utilized. If the ratio study is representative, upon
18certification by the Department, the assessor shall receive
19additional compensation of $3,000 for that year, to be paid out
20of funds appropriated to the Department from the Personal
21Property Tax Replacement Fund.
22    (e) As used in this Section: ,
23    "Assessor" "assessor" means any township or multi-township
24assessor, or supervisor of assessments.
25    "Coefficient of dispersion" means the average deviation of
26all assessments from the median level.
