2 | | AMENDMENT NO. ______. Amend Senate Bill 683 by replacing |
3 | | everything after the enacting clause with the following:
|
4 | | "Section 5. The Property Tax Code is amended by changing |
5 | | Section 4-20 as follows: |
6 | | (35 ILCS 200/4-20)
|
7 | | Sec. 4-20. Additional compensation based on performance. |
8 | | (a) Except as provided in subsection (c), any Any assessor |
9 | | in
counties with less than 3,000,000 but more than 50,000 |
10 | | inhabitants each
year may petition the Department to receive |
11 | | additional compensation based on
performance. To receive |
12 | | additional compensation, the official's assessment
|
13 | | jurisdiction must meet the following criteria:
|
14 | | (1) the median level of assessment must be no more than
|
15 | | 35 1/3% and no less than 31 1/3% of fair cash value of |
16 | | property
in his or her assessment jurisdiction; and
|

1 | | (2) the coefficient of dispersion must not be greater |
2 | | than 15%.
|
3 | | For purposes of this Section, "coefficient of dispersion" means |
4 | | the average
deviation of all assessments from the median level.
|
5 | | For purposes of this Section, the number of inhabitants shall |
6 | | be determined
by the latest federal decennial census. When the |
7 | | most
recent census shows an increase in inhabitants to over |
8 | | 50,000 or a decrease
to 50,000 or fewer, then the
assessment |
9 | | year used to compute the coefficient of dispersion and the most
|
10 | | recent year of the 3-year average level of assessments is the |
11 | | year that
determines qualification for additional
|
12 | | compensation.
The Department will
promulgate rules and |
13 | | regulations to determine whether an assessor meets these
|
14 | | criteria.
|
15 | | (b) Except as provided in subsection (c), any Any assessor |
16 | | in a county of 50,000 or fewer inhabitants may
petition the
|
17 | | Department for consideration to receive additional |
18 | | compensation each year
based on performance. In order to |
19 | | receive the additional compensation, the
assessments in the |
20 | | official's assessment jurisdiction must meet the following
|
21 | | criteria: (i) the median level of assessments must be no more |
22 | | than 35 1/3% and
no less than 31 1/3% of fair cash value of |
23 | | property in his or her assessment
jurisdiction; and (ii) the |
24 | | coefficient of dispersion must not be greater than
40% in 1994, |
25 | | 38% in 1995, 36% in 1996, 34% in 1997, 32% in 1998, and 30% in
|
26 | | 1999 and every year thereafter.

1 | | (c) With respect to assessors who are elected on or after |
2 | | the effective date of this amendatory Act of the 101st General |
3 | | Assembly in a qualified county, in lieu of the compensation |
4 | | provided in subsections (a) and (b), the township board of any |
5 | | township with an assessor who meets the criteria for additional |
6 | | compensation set forth in subsection (a) or (b), as applicable, |
7 | | may petition the Department for additional funding based on the |
8 | | assessor's performance. As used in this subsection, "qualified |
9 | | county" means DuPage, Kane, Lake, McHenry, or Will County. |
10 | | (d) Real estate transfer declarations used by the |
11 | | Department in annual
sales-assessment ratio studies will be |
12 | | used to evaluate applications for
additional compensation. The |
13 | | Department will audit other property to determine
if the |
14 | | sales-assessment ratio study data is representative of the |
15 | | assessment
jurisdiction. If the ratio study is found not |
16 | | representative, appraisals and
other information may be |
17 | | utilized. If the ratio study is representative, upon
|
18 | | certification by the Department, the assessor shall receive |
19 | | additional
compensation of $3,000 for that year, to be paid out |
20 | | of funds appropriated to
the Department from the Personal |
21 | | Property Tax Replacement Fund.

22 | | (e) As used in this Section : , |
23 | | "Assessor" "assessor" means any township or multi-township
|
24 | | assessor, or supervisor of assessments. |
25 | | "Coefficient of dispersion" means the average
deviation of |
26 | | all assessments from the median level.
|
