AMENDMENT TO SENATE BILL 556

2    AMENDMENT NO. ______. Amend Senate Bill 556 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Equitable Restrooms Act is amended by
5changing Section 20 and adding Section 25 as follows:
 
6    (410 ILCS 35/20)  (from Ch. 111 1/2, par. 3751-20)
7    Sec. 20. Application. Except for Section 25, this This Act
8applies only to places of public accommodation that commence
9construction, or that commence alterations exceeding 50% of the
10entire place of public accommodation, after the effective date
11of this Act.

14    Sec. 25. All-gender single-occupancy restrooms.
15    (a) In this Section:

1    "Place of public accommodation" has the same meaning
2provided in Section 5-101 of the Illinois Human Rights Act.
3    "Single-occupancy restroom" means a fully enclosed room,
4with a locking mechanism controlled by the user, containing a
5sink, toilet stall, and no more than one urinal.
6    (b) This Section applies to any existing or future places
7of public accommodation or public buildings.
8    (c) Notwithstanding any other provision of law, every
9single-occupancy restroom in a place of public accommodation or
10public building shall be identified as all-gender and
11designated for use by no more than one person at a time or for
12family or assisted use. Each single-occupancy restroom shall be
13outfitted with exterior signage indicating "all-gender" or
14"gender-neutral".
15    (d) During any inspection of a place of public
16accommodation or public building by a health officer or health
17inspector, the health officer or health inspector may inspect
18the place of public accommodation or public building to
19determine whether it complies with this Section.
20    (e) The Department of Public Health shall adopt rules to
21implement this Section.
 
22    Section 99. Effective date. This Act takes effect January
231, 2020.".
