HOUSE RESOLUTION

 
2    WHEREAS, On June 22, 1999, in Olmstead v. L.C., the United
3States Supreme Court held that the unjustified segregation of
4persons with disabilities constitutes discrimination in
5violation of Title II of the Americans with Disabilities Act;
6and
 
7    WHEREAS, The Olmstead ruling held that a person with a
8disability has the right to receive State-funded services and
9supports in the community rather than in an institution when
10the person's treatment professionals determine that the person
11is appropriate for community-based services, the person is not
12opposed to community-based services, and the provision of
13community-based services to the individual is a reasonable
14accommodation and not a fundamental alteration of the State's
15services; and
 
16    WHEREAS, In 2011, the State of Illinois entered into a
17consent decree in settlement of the Ligas class action lawsuit
18that was based upon the Olmstead decision and filed on behalf
19of a class of persons with developmental disabilities who were
20residing in private, State-funded facilities of nine or more
21persons or who were at risk of being placed in such facilities;
22and

1    WHEREAS, Illinois ranks 47th out of 50 states in annual
2spending for community-based services and supports; and
 
3    WHEREAS, Illinois has the second highest number of persons
4with intellectual or developmental disabilities living in
5institutions, exceeded only by Texas; and
 
6    WHEREAS, Almost 20,000 persons with intellectual or
7developmental disabilities are on the waiting list for
8developmental disabilities services in Illinois, including
9almost 7,500 who want services immediately; and
 
10    WHEREAS, The Going Home Coalition is a statewide Illinois
11network of self-advocates, family members, educators,
12advocates, and community leaders who support person-centered
13and responsive programs and systems that ensure persons with
14disabilities in Illinois the opportunity to live full and
15dignified lives in their own homes with full integration into
16their communities; and
 
17    WHEREAS, The Going Home Coalition commemorates the 20th
18anniversary of the Olmstead decision on June 22, 2019; and
 
19    WHEREAS, Twenty years after Olmstead, the State of Illinois
20continues to isolate and segregate persons with intellectual or
21developmental disabilities to a higher degree than most other

1states; therefore, be it
 
2    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
3HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
4we declare June 22, 2019 as Olmstead 20th Anniversary Day in
5the State of Illinois, and we urge the citizens of Illinois to
6recognize that day and be aware of its significance to persons
7with disabilities in Illinois; and be it further
 
8    RESOLVED, That a suitable copy of this resolution be
9presented to the Going Home Coalition as a symbol of our
10respect and esteem.
