Amends the Code of Civil Procedure. Provides that, unless the inclusion of sensitive data is required by law or rule, if a party receiving money from a settlement is a minor or a person with a disability, or was a minor when the action was filed, the terms of the settlement shall be sealed or the settlement shall redact sensitive information, as the court in its discretion shall rule in order to protect the interests of the party receiving the settlement money.

1 | | AN ACT concerning civil law.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Code of Civil Procedure is amended by adding |
5 | | Section 2-2302 as follows: |
6 | | (735 ILCS 5/2-2302 new) |
7 | | Sec. 2-2302. Privacy of information in certain |
8 | | settlements. Unless the inclusion of sensitive data is required |
9 | | by law or rule, if a party receiving money from a settlement is |
10 | | a minor or a person with a disability, or was a minor when the |
11 | | action was filed, the terms of the settlement shall be sealed |
12 | | or the settlement shall redact sensitive information, as the |
13 | | court in its discretion shall rule in order to protect the |
14 | | interests of the party receiving the settlement money. As used |
15 | | in this Section, "sensitive information" includes: |
16 | | (1) personal identity information as defined in |
17 | | Supreme Court Rule 138; and |
18 | | (2) the birth date, home address, and name of any |
19 | | person who was a minor when the action was filed.
