2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2WWW as follows: |
6 | | (815 ILCS 505/2WWW new) |
7 | | Sec. 2WWW. Internet customer confidentiality. |
8 | | (a) As used in this Section, "Internet service provider" |
9 | | means any person, business, or organization qualified to do |
10 | | business in this State that provides individuals, |
11 | | corporations, or other entities with the ability to connect to |
12 | | the Internet through equipment that is located in this State. |
13 | | (b) An Internet service provider offering services to |
14 | | Illinois consumers shall keep all customer information |
15 | | confidential unless the customer provides written consent to a |
16 | | disclosure. |
17 | | (c) An Internet service provider that violates this Section |
18 | | commits an unlawful practice within the meaning of this Act |
19 | | and, in addition, is subject to a penalty of $500 for each |
20 | | violation.

21 | | Section 99. Effective date. This Act takes effect upon |
22 | | becoming law.
