Amends the Humane Care for Animals Act. Provides that no person may knowingly allow an animal to ingest cannabis, including second-hand smoke, or cannabis-infused products in a way that results in the animal's sickness or death. Provides that a first violation is a Class A misdemeanor, and a second or subsequent violation is a Class 4 felony. Effective immediately.

1 | | AN ACT concerning local government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Humane Care for Animals Act is amended by |
5 | | adding Section 6.5 as follows: |
6 | | (510 ILCS 70/6.5 new) |
7 | | Sec. 6.5. Animal ingestion of cannabis or cannabis-infused |
8 | | product. |
9 | | (a) As used in this Section, "cannabis" and |
10 | | "cannabis-infused product" have the meanings given to those |
11 | | terms in the Cannabis Regulation and Tax Act. |
12 | | (b) No person may knowingly allow an animal to ingest |
13 | | cannabis, including second-hand smoke, or cannabis-infused |
14 | | products in a way that results in the animal's sickness or |
15 | | death. |
16 | | (c) A person convicted of violating this Section is guilty |
17 | | of a Class A misdemeanor. A second or subsequent violation is a |
18 | | Class 4 felony.

19 | | Section 99. Effective date. This Act takes effect upon |
20 | | becoming law.
