Amends the Illinois Vehicle Code. Deletes language allowing the driver of a vehicle with 3 or more wheels to overtake and pass upon the right of another vehicle upon a roadway with unobstructed pavement of sufficient width for 2 or more lines of vehicles moving lawfully in the directing being traveled by the overtaking vehicle. Effective January 1, 2021.

| 1 | | AN ACT concerning transportation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing |
| 5 | | Section 11-704 as follows:
|
| 6 | | (625 ILCS 5/11-704) (from Ch. 95 1/2, par. 11-704)
|
| 7 | | Sec. 11-704. When overtaking on the right is permitted. |
| 8 | | (a) The driver of a vehicle with 3 or more wheels may |
| 9 | | overtake and pass
upon the right of another vehicle only under |
| 10 | | the following conditions:
|
| 11 | | 1. When the vehicle overtaken is making or about to |
| 12 | | make a left turn. ;
|
| 13 | | 2. (Blank). Upon a roadway with unobstructed pavement |
| 14 | | of sufficient width for
two or more lines of vehicles |
| 15 | | moving lawfully in the direction being
traveled by the |
| 16 | | overtaking vehicle.
|
| 17 | | 3. Upon a one-way street, or upon any roadway on which |
| 18 | | traffic is
restricted to one direction of movement, where |
| 19 | | the roadway is free from
obstructions and of sufficient |
| 20 | | width for 2 or more lines of moving
vehicles.

| 21 | | (b) The driver of a 2 wheeled vehicle may not pass upon the |
| 22 | | right of any
other vehicle proceeding in the same direction |
| 23 | | unless the unobstructed
pavement to the right of the vehicle |
