Amends the Children with Disabilities Article of the School Code. Provides that the parent or guardian of a child with disabilities who resides in a school district shall have the option of enrolling the child in a school district in which the child was previously enrolled as long as that school district is, in whole or in part, within the county in which the child currently resides. Requires the school district in which the child currently resides to grant proper permit to the child's parent or guardian to allow the child to enroll in a school district outside of the district in which he or she resides. Sets forth provisions concerning special education reimbursement, evidence-based funding, and transportation costs. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Section |
5 | | 14-7.01a as follows: |
6 | | (105 ILCS 5/14-7.01a new) |
7 | | Sec. 14-7.01a. Children enrolling in previous district. |
8 | | (a) In this Section, "enrolling school district" means a |
9 | | school district in which a parent or guardian chooses to enroll |
10 | | a child with disabilities outside of the school district in |
11 | | which the child currently resides, but within, in whole or in |
12 | | part, the county in which the child currently resides. |
13 | | (b) The parent or guardian of a child with disabilities who |
14 | | resides in a school district shall have the option of enrolling |
15 | | the child in a school district in which the child was |
16 | | previously enrolled as long as that school district is, in |
17 | | whole or in part, within the county in which the child |
18 | | currently resides. The school district in which the child |
19 | | currently resides shall grant proper permit to the child's |
20 | | parent or guardian to allow the child to enroll in a school |
21 | | district outside of the district in which he or she resides. |
