SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/12-4.53 new

    Amends the Illinois Public Aid Code. Requires every person applying for benefits under the federal Supplemental Nutrition Assistance Program to, at the time of application or subsequent redetermination of eligibility, submit to the Department of Human Services documentation demonstrating that the person is enrolled in an adult education program as defined in the Adult Education Act or in an educational program that is expected to result in the receipt of a high school equivalence certificate. Exempts certain persons from the requirement. Provides that the Department shall apply for any federal waiver, if required, to implement the requirement.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 12-4.53 as follows:
 
6    (305 ILCS 5/12-4.53 new)
7    Sec. 12-4.53. SNAP; adult education requirement.
8Notwithstanding any other provision of this Code to the
9contrary, every person applying for benefits under the federal
10Supplemental Nutrition Assistance Program shall, at the time of
11application or subsequent redetermination of eligibility,
12submit to the Department of Human Services documentation
13demonstrating that the person is enrolled in an adult education
14program as defined in the Adult Education Act or in an
15educational program that is expected to result in the receipt
16of a high school equivalence certificate. The following persons
17are exempt from the requirement of this Section:
18        (1) Persons who are over the age of 60.
19        (2) Persons with a child under the age of one.
20        (3) Persons enrolled in a technical or trade school.
21    Persons with a disability as defined by the Americans with
22Disabilities Act are entitled to request a reasonable
23modification to the requirement of participation in an adult

1education program or educational program that is expected to
2result in the receipt of a high school equivalence certificate.
3Requests for a reasonable modification shall be evaluated on a
4case-by-case functional basis by designated staff based on
5Department rule.
6    The Department of Human Services shall apply for any
7federal waiver, if required, to implement the requirement under
8this Section. Implementation shall be contingent upon federal
9approval, if required.
