Amends the Nursing Home Care Act and the Hospital Licensing Act. Beginning July 1, 2021, requires long-term care facilities licensed under the Nursing Home Care Act and hospitals licensed under the Hospital Licensing Act to prove upon inspection by the Department of Public Health that the long-term care facility or hospital has provided testing for Legionnaires disease and to provide the results of that testing to the Department.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Nursing Home Care Act is amended by adding |
5 | | Sections 3-206.06 and 6.28 as follows: |
6 | | (210 ILCS 45/3-206.06 new) |
7 | | Sec. 3-206.06. Testing for Legionnaires. A facility |
8 | | licensed under this Act must prove upon inspection by the |
9 | | Department that it has provided testing for Legionnaires |
10 | | disease. The facility must also provide the results of that |
11 | | testing to the Department. |

13 | | Sec. 6.28. Testing for Legionnaires. A hospital licensed |
14 | | under this Act must prove upon inspection by the Department |
15 | | that it has provided testing for Legionnaires disease. The |
