SYNOPSIS AS INTRODUCED:
 
420 ILCS 40/6  from Ch. 111 1/2, par. 210-6

    Amends the Radiation Protection Act of 1990. Removes provisions regarding rules or regulations promulgated by the Illinois Emergency Management Agency for registration of persons seeking accreditation to perform a limited scope of diagnostic radiography procedures. Removes language providing that, upon expiration of a 16 month training period, a student shall be prohibited from performing diagnostic radiography procedures unless accredited by the Agency to perform such procedures. Provides that accreditation requires passing an examination approved (currently, offered) by the Agency. Makes other changes. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Radiation Protection Act of 1990 is amended
5by changing Section 6 as follows:
 
6    (420 ILCS 40/6)  (from Ch. 111 1/2, par. 210-6)
7    (Section scheduled to be repealed on January 1, 2021)
8    Sec. 6. Accreditation of administrators of radiation;
9Limited scope accreditation; Rules and regulations; Education.
10    (a) The Agency shall promulgate such rules and regulations
11as are necessary to establish accreditation standards and
12procedures, including a minimum course of education and
13continuing education requirements in the administration of
14radiation to human beings, which are appropriate to the
15classification of accreditation and which are to be met by all
16physician assistants, advanced practice registered nurses,
17nurses, technicians, or other assistants who administer
18radiation to human beings under the supervision of a person
19licensed under the Medical Practice Act of 1987. Such rules and
20regulations may provide for different classes of accreditation
21based on evidence of national certification, clinical
22experience or community hardship as conditions of initial and
23continuing accreditation. The rules and regulations of the

1Agency shall be consistent with national standards in regard to
2the protection of the health and safety of the general public.
3    (b) The rules and regulations shall also provide that
4persons who have been accredited by the Agency, in accordance
5with the Radiation Protection Act, without passing an
6examination, will remain accredited as provided in Section 43
7of this Act and that those persons may be accredited, without
8passing an examination, to use other equipment, procedures, or
9supervision within the original category of accreditation if
10the Agency receives written assurances from a person licensed
11under the Medical Practice Act of 1987, that the person
12accredited has the necessary skill and qualifications for such
13additional equipment procedures or supervision. The Agency
14shall, in accordance with subsection (c) of this Section,
15provide for the accreditation of nurses, technicians, or other
16assistants, unless exempted elsewhere in this Act, to perform a
17limited scope of diagnostic radiography procedures of the
18chest, the extremities, skull and sinuses, or the spine, while
19under the supervision of a person licensed under the Medical
20Practice Act of 1987.
21    (c) The rules or regulations promulgated by the Agency
22pursuant to subsection (a) shall establish standards and
23procedures for accrediting persons to perform a limited scope
24of diagnostic radiography procedures. The rules or regulations
25shall require persons seeking limited scope accreditation to
26register with the Agency as a "student-in-training," and

1declare those procedures in which the student will be receiving
2training. The student-in-training registration shall be valid
3for a period of 16 months, during which the time the student
4may, under the supervision of a person licensed under the
5Medical Practice Act of 1987, perform the diagnostic
6radiography procedures listed on the student's registration.
7The student-in-training registration shall be nonrenewable.
8    For an individual Upon expiration of the 16 month training
9period, the student shall be prohibited from performing
10diagnostic radiography procedures unless accredited by the
11Agency to perform such procedures. In order to be accredited to
12perform a limited scope of diagnostic radiography procedures,
13he or she an individual must pass an examination approved
14offered by the Agency. The examination shall be consistent with
15national standards in regard to protection of public health and
16safety. The examination shall consist of a standardized
17component covering general principles applicable to diagnostic
18radiography procedures and a clinical component specific to the
19types of procedures for which accreditation is being sought.
20The Agency may assess a reasonable fee for such examinations to
21cover any the costs incurred by the Agency in conjunction with
22offering the examinations.
23    (d) The Agency shall by rule or regulation exempt from
24accreditation physician assistants, advanced practice
25registered nurses, nurses, technicians, or other assistants
26who administer radiation to human beings under supervision of a

1person licensed to practice under the Medical Practice Act of
21987 when the services are performed on employees of a business
3at a medical facility owned and operated by the business. Such
4exemption shall only apply to the equipment, procedures and
5supervision specific to the medical facility owned and operated
6by the business.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
