Amends the Children and Family Services Act. Provides that if a person under the age of 21 dies while in the guardianship of the Department of Children and Family Services under the Abused, Neglected or Dependent Minors Article of the Juvenile Court Act of 1987, the Department's guardianship of the person shall not terminate upon the person's death and the Department may make such arrangements as it deems appropriate for the dignified disposition of the person's remains. Provides that if funds to pay the person's funeral and burial expenses are not available from any other source, the Department may, subject to appropriation, pay the person's reasonable funeral and burial expenses. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Children and Family Services Act is amended |
5 | | by adding Section 44 as follows: |
6 | | (20 ILCS 505/44 new) |
7 | | Sec. 44. Funeral and burial arrangements. Notwithstanding |
8 | | any other law or rule to the contrary, if a person under the |
9 | | age of 21 dies while in the guardianship of the Department of |
10 | | Children and Family Services under Article II of the Juvenile |
11 | | Court Act of 1987, the Department's guardianship of the person |
12 | | shall not terminate upon the person's death and the Department |
13 | | may make such arrangements as it deems appropriate for the |
14 | | dignified disposition of the person's remains. If funds to pay |
15 | | the person's funeral and burial expenses are not available from |
16 | | any other source, the Department may, subject to appropriation, |
17 | | pay the person's reasonable funeral and burial expenses.

18 | | Section 99. Effective date. This Act takes effect upon |
19 | | becoming law.
