SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Illinois Veterans' Home in Quincy Foundation Act. Authorizes the Secretary of State to create the Illinois Veterans' Home in Quincy Foundation. Provides further requirements concerning the establishment of the Foundation. Provides for officers of the Foundation. Provides that funds collected by the Foundation shall be used for private partnership projects that will support renovations to the Illinois Veterans Home in Quincy campus, Dudley House, and domiciliary buildings. Provides further requirements concerning Foundation funds. Provides for the adoption of rules. Provides purpose provisions.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Illinois Veterans' Home in Quincy Foundation Act.
 
6    Section 5. Purpose. The purpose of this Act is to establish
7a Foundation to support projects for the renovation of the
8Illinois Veterans' Home in Quincy. Grants have been previously
9proposed to renovate the Veterans' Home, including domiciliary
10buildings for guest house services to replace existing
11structures that will soon be demolished. Funds collected by the
12Foundation created under this Act will be used for such
13renovations with the belief that the renovations will not only
14benefit the community and create revenue, but also foster
15further renovation opportunities through the creation of
16nonprofit partnership projects that allow corporations a
17tax-deductible donation.
 
18    Section 10. Illinois Veterans' Home in Quincy Foundation.
19The Secretary of State is authorized, in accordance with
20Section 10 of the State Agency Entity Creation Act, to create a
21not-for-profit foundation that shall be known as the Illinois
22Veterans' Home in Quincy Foundation. The Secretary shall file

1articles of incorporation and bylaws as required under the
2General Not For Profit Corporation Act of 1986 to create the
3Foundation. The Foundation shall not exceed the provisions of
4the General Not For Profit Corporation Act of 1986. There shall
5be not less than 6 nor more than 11 Directors of the Foundation
6to be appointed by the Secretary of State, with the advice and
7consent of the Senate. The Secretary of State or his or her
8designee shall serve as an ex officio Director of the
9Foundation. No Director may receive compensation for his or her
10services to the Foundation.
 
11    Section 15. Selecting officers; rules. As soon as practical
12after the Foundation is created, the Directors shall meet,
13organize, and designate, by majority vote, a Chairperson,
14Secretary, Treasurer, and any additional officers as may be
15needed to carry out the activities of the Foundation. The
16Secretary of State may adopt rules deemed necessary to govern
17Foundation procedures.
 
18    Section 20. Funds collected by the Foundation.
19    (a) Funds collected by the Foundation shall be used for
20private partnership projects that will support renovations to
21the Illinois Veterans Home in Quincy campus, Dudley House, and
22domiciliary buildings.
23    (b) The Foundation may accept gifts or grants from the
24federal government, its agencies or officers, or from any

1person, firm, corporation, or private foundation, and may
2expend receipts on activities that it considers suitable to the
3performance of its duties under this Act.
4    (c) Funds collected by the Foundation shall be considered
5private funds and shall be held in an appropriate account
6outside of the State treasury. The Treasurer of the Foundation
7shall be custodian of all Foundation funds.
8    (d) The Foundation's accounts and books shall be set up and
9maintained in a manner approved by the Auditor General and the
10Foundation and its officers shall be responsible for the
11approval of recording of receipts, the approval of payments,
12and the proper filing of required reports.
13    (e) The Foundation may be assisted in carrying out its
14functions by personnel of the Office of the Secretary of State
15with respect to matters falling within their scope and
16function. The Foundation shall cooperate fully with the boards,
17commissions, agencies, departments, and institutions of the
18State.
19    (f) The funds held and made available by the Illinois
20Veterans' Home in Quincy Foundation shall be subject to
21financial and compliance audits by the Auditor General in
22compliance with the Illinois State Auditing Act.
