SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/3.1-55-30 new

    Amends the Illinois Municipal Code. Provides that a municipality may not prohibit input or comments by the public or city council after a petitioner (a person or entity who initiated and has a direct financial or ownership interest concerning a particular agenda item) has addressed the city council. Provides that the municipality may limit the time of input or comments by the public or city council after a petitioner addresses the city council. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 3.1-55-30 as follows:
 
6    (65 ILCS 5/3.1-55-30 new)
7    Sec. 3.1-55-30. Petitioners at city council meetings.
8    (a) As used in this Section, "petitioner" means a person or
9entity who initiated and has a direct financial or ownership
10interest concerning a particular agenda item.
11    (b) Notwithstanding any other provision of law, a
12municipality may not prohibit input or comments by the public
13or city council after a petitioner has addressed the city
14council. This subsection does not prohibit a municipality from
15limiting the time of input or comments by the public or city
16council after a petitioner addresses the city council.
17    (c) A home rule municipality may not regulate input or
18comments by the public or the city council in a manner
19inconsistent with this Section. This Section is a limitation
20under subsection (i) of Section 6 of Article VII of the
21Illinois Constitution on the concurrent exercise by home rule
22units of powers and functions exercised by the State.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
