Amends the Illinois Municipal Code. Provides that a municipality may not prohibit a speaker at a public meeting from addressing an individual member of the city council, a municipal official, or a staff member of these individuals, except that these provisions do not prohibit a municipality from limiting when a speaker may speak at a meeting. Limits home rule powers. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 3.1-55-30 as follows: |
6 | | (65 ILCS 5/3.1-55-30 new) |
7 | | Sec. 3.1-55-30. Addressing city council members at public |
8 | | meetings. |
9 | | (a) Notwithstanding any other provision of law, a |
10 | | municipality may not prohibit a speaker at a public meeting |
11 | | from addressing an individual member of the city council, a |
12 | | municipal official, or a staff member of these individuals. |
13 | | This subsection does not prohibit a municipality from limiting |
14 | | when a speaker may speak at a meeting. |
15 | | (b) A home rule municipality may not regulate addressing |
16 | | individual city council members, municipal officials, or staff |
17 | | members of these individuals at a city council meeting in a |
18 | | manner inconsistent with this Section. This Section is a |
19 | | limitation under subsection (i) of Section 6 of Article VII of |
20 | | the Illinois Constitution on the concurrent exercise by home |
21 | | rule units of powers and functions exercised by the State.
