SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/1-6003.5 new

    Amends the Counties Code. Provides that the chairperson of the county board may appoint, with the advice and consent of the county board, an outside attorney to serve as legal counsel to the county board. The chairperson may choose the State's Attorney as legal counsel who shall receive additional compensation as appropriate. Provides that the chairperson, by written order filed with the county clerk, may discontinue the appointment of the outside counsel appointed and prevents compensation to the outside counsel after the discontinuance. Provides that the duty of a State's Attorney to be legal counsel are in addition to the statutory duties of the State's Attorney and the State's Attorney shall not receive additional compensation for the duties performed.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
51-6003.5 as follows:
 
6    (55 ILCS 5/1-6003.5 new)
7    Sec. 1-6003.5. Legal representation for county board.
8    (a) The chairperson of the county board may appoint, with
9the advice and consent of the county board, an outside attorney
10to serve as legal counsel to the county board. The chairperson
11may choose the State's Attorney as legal counsel.
12    (b) The county board chairperson, by written order filed
13with the county clerk, may discontinue the appointment of the
14outside counsel appointed under subsection (a) of this Section.
15After discontinuance, no outside counsel filling the office
16before the discontinuance shall have any claim against the
17county for compensation alleged to accrue after the date of
18discontinuance.
19    (c) Vacancies for outside counsel may be filled in the same
20manner as appointments are made under subsection (a).
21    (d) The duty of a State's Attorney to be legal counsel
22under this Section is in addition to the duties of the State's
23Attorney under Division 3-9 and the State's Attorney shall not
