Amends the Township Code. Provides that tentative budgets for specified road districts shall be subject to a public hearing and public inspection prior to adopting. Further provides that the township board may adopt all or part of the tentative budget and appropriation ordinance for road purposes and levy the amount determined by the board (currently, the township board shall adopt all the tentative budget and appropriation ordinance and levy the amount determined by the highway commissioner). Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Township Code is amended by changing Section |
5 | | 235-25 as follows:
|
6 | | (60 ILCS 1/235-25)
|
7 | | Sec. 235-25. Tentative budget and appropriation ordinance |
8 | | and tax
for road purposes. In each road district comprised of |
9 | | a single township : |
10 | | (a) The township board must hold a public hearing before |
11 | | adopting a budget and appropriation ordinance for road |
12 | | purposes. |
13 | | (b) The township board must, at least 30 days before a |
14 | | public hearing, prepare or cause to be prepared a tentative |
15 | | budget and appropriation ordinance for road purposes and file |
16 | | the ordinance with the township clerk. The township clerk must |
17 | | make the tentative budget and appropriation ordinance for road |
18 | | purposes available for public inspection for at least 30 days |
19 | | before final action on the ordinance. The required public |
20 | | hearing must be held on or before the last day of the first |
21 | | quarter of the fiscal year before the township board. Notice of |
22 | | the hearing must be given by publication in a newspaper |
23 | | published in the township at least 30 days before the time of |
