SYNOPSIS AS INTRODUCED:
 
410 ILCS 50/3.5 new

    Amends the Medical Patient Rights Act. Provides that it is the policy of this State that managed care companies or third-party payers shall not mandate that health care professionals use a specific electronic medical records software system in order to provide or bill for services to patients. Prohibits specified insurance policies, plans, or arrangements for the purchase of health care, payment for health care, or reimbursement for health care, or an agency of the State or of any municipality, county, district, or other political subdivision of the State, from discriminating with respect to the provision of, or contracts for, health care or related services against a health care professional on the basis of that health care professional's utilization of a specific electronic medical records software system.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Medical Patient Rights Act is amended by
5adding Section 3.5 as follows:
 
6    (410 ILCS 50/3.5 new)
7    Sec. 3.5. Electronic medical record software.
8    (a) It is the policy of this State that managed care
9companies or third-party payers shall not mandate that health
10care professionals use a specific electronic medical records
11software system in order to provide or bill for services to
12patients.
13    (b) Notwithstanding any other provision of law, the
14following shall not discriminate with respect to the provision
15of, or contracts for, health care or related services against a
16health care professional on the basis of that health care
17professional's utilization of a specific electronic medical
18records software system:
19        (1) a health care service plan;
20        (2) a managed health care plan;
21        (3) a health maintenance organization plan;
22        (4) a preferred provider plan;
23        (5) a managed competition plan;

1        (6) a policy of disability insurance;
2        (7) a self-insured employer welfare benefit plan;
3        (8) a health insurance purchasing cooperative;
4        (9) any other insurance policy, plan, or arrangement
5for the purchase of health care, payment for health care, or
6reimbursement for health care; or
7        (10) an agency of the State or of any municipality,
8county, district, or other political subdivision of the State.
