SYNOPSIS AS INTRODUCED:

    Amends the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004. In a provision requiring training for registered employees of a private detective agency within 30 days of their employment, specifies that the training may be classroom-based or online Internet-based and removes certain topics that must be included in that training. Provides that registered employees of a private detective agency, private detectives, and private security contractors shall complete an additional 8 hours of annual training each calendar year. Provides that the annual training for registered employees shall be based on subjects related to the work performed and may be conducted in a classroom or seminar setting or through Internet-based online learning programs. Provides that the annual training for private detectives and private security contractors shall be on a topic of their choosing, provided that the subject matter is reasonably related to their private detective or private security contractor practice. Specifies that the annual training for private detectives may be completed utilizing any combination of hours obtained in a formal educational classroom setting or Internet-based online training resources. Specifies that a minimum of 4 hours of the annual training for private security contractors must be completed in a formal educational classroom setting. Makes changes to provisions concerning employer certification of training. Requires private detectives and private security officers to keep and maintain a personal log of all training hours earned with sufficient documentation to verify the annual training was completed for at least 5 years. Makes other changes.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Private Detective, Private Alarm, Private
5Security, Fingerprint Vendor, and Locksmith Act of 2004 is
6amended by changing Sections 15-25 and 25-20 as follows:

8    (Section scheduled to be repealed on January 1, 2024)
9    Sec. 15-25. Training; private detective and employees.
10    (a) Registered employees of a private detective agency
11shall complete, within 30 days of their employment, a minimum
12of 20 hours of basic training provided by a qualified
13instructor. The substance of the training shall be related to
14the work performed by the registered employee. The training may
15be classroom-based or online Internet-based but shall not be
16conducted as on-the-job training and shall include relevant
17information as to the identification of terrorists, acts of
18terrorism, and terrorist organizations, as defined by federal
19and State statutes.
20    (a-5) In addition to the basic training required in
21subsection (a), registered employees of a private detective
22agency shall complete an additional minimum of 8 hours of
23annual training for every calendar year, commencing with the

1calendar year beginning after the employee's hire date.
2    (a-10) Annual training for registered employees shall be
3based on subjects related to the work performed as determined
4by the employer and may be conducted in a classroom or seminar
5setting or via Internet-based online learning programs. Annual
6training may not be conducted as on-the-job training.
7    (b) It is the responsibility of the employer to certify, on
8a form provided by the Department, that the employee has
9successfully completed the basic and annual training. The
10original form or a copy shall be a permanent record of training
11completed by the employee and shall be placed in the employee's
12file with the employer for the period the employee remains with
13the employer. An agency may place a notarized copy of the
14Department form in lieu of the original into the permanent
15employee registration card file. The original form shall be
16given to the employee when his or her employment is terminated.
17Failure to return the original form to the employee is grounds
18for disciplinary action. The employee shall not be required to
19repeat the required training once the employee has been issued
20the form. An employer may provide or require additional
21training.
22    (c) (Blank). Any certification of completion of the 20-hour
23basic training issued under the Private Detective, Private
24Alarm, Private Security, and Locksmith Act of 1993 or any prior
25Act shall be accepted as proof of training under this Act.
26    (d) All private detectives shall complete a minimum of 8

1hours of annual training on a topic of their choosing, provided
2that the subject matter is reasonably related to their private
3detective practice. The annual training for private detectives
4may be completed utilizing any combination of hours obtained in
5a formal educational classroom setting, including, but not
6limited to, a live educational workshop or seminar offered by
7any industry-related product manufacturer or service provider,
8any recognized state or national industry association, any
9recognized continuing education provider, or by any accredited
102-year or 4-year college or university, or through
11Internet-based online training resources.
12    (e) The annual training requirements for private
13detectives shall not apply until the calendar year following
14the issuance of the private detective license.
15    (f) It shall be the responsibility of the private detective
16to keep and maintain a personal log of all training hours
17earned along with sufficient documentation for the Department
18to verify the annual training completed for at least 5 years.
19The personal training log and documentation shall be provided
20to the Department in the same manner as other documentation and
21records required under this Act.
22    (g) Recognizing the diverse professional practices of
23private detectives licensed under this Act, it is the intent of
24the training requirements in this Section to allow for a broad
25interpretation of the coursework, seminar subjects, or class
26topics to be considered reasonably related to the practice of

1any profession licensed under this Act.
2    (h) Notwithstanding any other professional license a
3private detective holds under this Act, no more than 8 hours of
4annual training shall be required for any one year.

8    Sec. 25-20. Training; private security contractor and
9employees.
10    (a) Registered employees of the private security
11contractor agency who provide traditional guarding or other
12private security related functions or who respond to alarm
13systems shall complete, within 30 days of their employment, a
14minimum of 20 hours of classroom basic training provided by a
15qualified instructor, which shall include the following
16subjects:
17        (1) The law regarding arrest and search and seizure as
18    it applies to private security.
19        (2) Civil and criminal liability for acts related to
20    private security.
21        (3) The use of force, including but not limited to the
22    use of nonlethal force (i.e., disabling spray, baton,
23    stungun, taser, or similar weapon).
24        (4) Verbal communication skills Arrest and control
25    techniques.

1        (5) The offenses under the Criminal Code of 2012 that
2    are directly related to the protection of persons and
3    property.
4        (6) Private security officers and the criminal justice
5    system The law on private security forces and on reporting
6    to law enforcement agencies.
7        (7) Fire prevention, fire equipment, and fire safety.
8        (8) Report The procedures for report writing and
9    observation techniques.
10        (9) Customer service Civil rights and public
11    relations.
12        (10) The identification of terrorists, acts of
13    terrorism, and terrorist organizations, as defined by
14    federal and State statutes.
15    (b) All other employees of a private security contractor
16agency shall complete a minimum of 20 hours of training
17provided by the qualified instructor within 30 days of their
18employment. The substance of the training shall be related to
19the work performed by the registered employee.
20    (c) Registered employees of the private security
21contractor agency who provide guarding or other private
22security related functions, in addition to the classroom
23training required under subsection (a), within 6 months of
24their employment, shall complete an additional 8 hours of
25training on subjects to be determined by the employer, which
26training may be site-specific and may be conducted on the job.

1    (d) In addition to the basic training provided for in
2subsections (a) and (c), registered employees of the private
3security contractor agency who provide guarding or other
4private security related functions shall complete an
5additional 8 hours of refresher training on subjects to be
6determined by the employer each calendar year commencing with
7the calendar year following the employee's first employment
8anniversary date, which refresher training may be
9site-specific and may be conducted on the job.
10    (e) It is the responsibility of the employer to certify, on
11a form provided by the Department, that the employee has
12successfully completed the basic and refresher training. The
13original form or a copy shall be a permanent record of training
14completed by the employee and shall be placed in the employee's
15file with the employer for the period the employee remains with
16the employer. An agency may place a notarized copy of the
17Department form in lieu of the original into the permanent
18employee registration card file. The original form shall be
19given to the employee when his or her employment is terminated.

2Act shall be accepted as proof of training under this Act.
3    (g) All private security contractors shall complete a
4minimum of 8 hours of annual training on a topic of their
5choosing, provided that the subject matter of the training is
6reasonably related to their private security contractor
7practice. A minimum of 4 hours of the annual training must be
8completed in a formal educational classroom setting,
9including, but not limited to, a live continuing education
10seminar offered by any recognized state or national industry
11association, any recognized continuing education provider, or
12by any 2-year or 4-year college or university. No more than 4
13hours of the annual training may be completed utilizing online
14training materials, online videos, or other similar training
15materials available via the Internet or through the reading of
16professional journals or publications.
17    (h) It shall be the responsibility of the private security
18contractor to keep and maintain a personal log of all training
19hours earned along with sufficient documentation necessary for
20the Department to verify the annual training completed for at
21least 5 years. The personal training log and documentation
22shall be provided to the Department in the same manner as other
23documentation and records required under this Act.
24    (i) Recognizing the diverse professional practices of
25private security contractors licensed under this Act, it is the
26intent of the training requirements in this Section to allow

1for a broad interpretation of the coursework, seminar subjects,
2or class topics to be considered reasonably related to the
3practice of any profession licensed under this Act.
4    (j) Notwithstanding any other professional license a

68 hours of annual training shall be required for any one year.
7    (k) The annual training requirements for private security
8contractors shall not apply until the calendar year following
9the issuance of the private security contractor license.
