Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that the governing body of a county, township, or municipality may waive any fees or costs associated with a permit, inspection, or certification of occupancy required by law for construction, reconstruction, alteration, repair, movement to another site, removal, or demolition of a manufactured home, building, dwelling, or structure, either commercial or residential, damaged as a result of a disaster, emergency, weather event, or for any reason deemed warranted in the interests of public safety, welfare, and recovery of the community by the governing body of the county, township, or municipality. Defines "disaster". Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Counties Code is amended by adding Section |
5 | | 5-12001.3 as follows: |
6 | | (55 ILCS 5/5-12001.3 new) |
7 | | Sec. 5-12001.3. Waiver of building, inspection, and |
8 | | construction fees. |
9 | | (a) As used in this Section, "disaster" includes, but is |
10 | | not limited to, an occurrence or threat of widespread or severe |
11 | | damage, injury, or loss of life or property resulting from any |
12 | | natural or technological cause, including, but not limited to, |
13 | | fire, flood, earthquake, wind, storm, hazardous materials |
14 | | spill, or other water contamination, epidemic, air |
15 | | contamination, blight, extended periods of severe, and |
16 | | inclement weather, drought, infestation, critical shortages of |
17 | | essential fuels and energy, explosion, riot, hostile military |
18 | | or paramilitary action, public health emergencies, or acts of |
19 | | domestic terrorism. |
20 | | (b) Notwithstanding any other provision of law, a county |
21 | | board or board of county commissioners may, by resolution, |
22 | | waive any fees or costs associated with a permit, inspection, |
23 | | or certification of occupancy required by law for construction, |

9 | | welfare, and recovery of the community by the board of trustees |
10 | | of the township. |
11 | | Section 15. The Illinois Municipal Code is amended by |
12 | | adding Section 11-13-1.2 as follows: |

14 | | Section 99. Effective date. This Act takes effect upon |
15 | | becoming law.
