1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Department of Transportation Law of the
| ||||||
5 | Civil Administrative Code of Illinois is amended by changing | ||||||
6 | Section 2705-615 as follows: | ||||||
7 | (20 ILCS 2705/2705-615) | ||||||
8 | Sec. 2705-615. Supplemental funding; Illinois | ||||||
9 | Transportation Enhancement Program. | ||||||
10 | (a) Each year, in In addition to any other funding that may | ||||||
11 | be provided to the Illinois Transportation Enhancement Program | ||||||
12 | from federal, State, or other sources, including, but not | ||||||
13 | limited to, the Transportation Alternatives Set-Aside of the | ||||||
14 | Surface Transportation Block Grant Program, the Department | ||||||
15 | shall set aside $50,000,000 received by the Department from the | ||||||
16 | Road Fund for the projects in the following categories: | ||||||
17 | pedestrian and bicycle facilities and the conversion of | ||||||
18 | abandoned railroad corridors to trails. | ||||||
19 | (b) Except as provided in subsection (c), funds set aside | ||||||
20 | under subsection (a) shall be administered according to the | ||||||
21 | requirements of the current Guidelines Manual published by the | ||||||
22 | Department for the Illinois Transportation Enhancement | ||||||
23 | Program, including, but not limited to, decision-making by the |

1 | Department and the applicable Metropolitan Planning | ||||||
2 | Organization and proportional fund distribution according to | ||||||
3 | population size. | ||||||
4 | (c) For projects funded under this Section: | ||||||
5 | (1) local matching funding shall be required according | ||||||
6 | to a sliding scale based on community size, median income, | ||||||
7 | and percentage of population living below the federal | ||||||
8 | poverty line total property tax base ; | ||||||
9 | (2) Phase I Studies and Phase I Engineering Reports are | ||||||
10 | not required to be completed before application is made; | ||||||
11 | and | ||||||
12 | (3) at least 25% of funding shall be directed towards | ||||||
13 | projects in high-need communities, based on community | ||||||
14 | median income and percentage of population living below the | ||||||
15 | federal poverty line total property tax base . | ||||||
16 | (d) The Department shall adopt rules necessary to implement | ||||||
17 | this Section. | ||||||
18 | (e) The Department shall adhere to a 2-year funding cycle | ||||||
19 | for the Illinois Transportation Enhancement Program with calls | ||||||
20 | for projects at least every other year. | ||||||
21 | (f) The Department shall make all funded and unfunded the | ||||||
22 | Illinois Transportation Enhancement Program applications | ||||||
23 | publicly available upon completion of each funding cycle, | ||||||
24 | including how each application scored on the program criteria.
