Amends the Children with Disabilities Article of the School Code. Requires a school district to provide notification to the parent or guardian of a student with an individualized education program (IEP) that the student may be eligible to receive additional specified services, benefits, or resources. Provides that the written notification must be provided no later than 30 days following the implementation of the initial IEP and once a year thereafter. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Section |
5 | | 14-17 as follows: |
6 | | (105 ILCS 5/14-17 new) |
7 | | Sec. 14-17. Parental notification of additional resources. |
8 | | (a) In this Section: |
9 | | "PUNS" means the Prioritization of Urgency of Need for |
10 | | Services database established under Section 10-26 of the |
11 | | Department of Human Services Act. |
12 | | "Special-needs trust" means a special-needs trust as |
13 | | defined in Section 1213 of the Illinois Trust Code. |
14 | | "SSI" means federal Supplemental Security Income. |
15 | | (b) A school district must provide written notification to |
16 | | the parent or guardian of a student with an individualized |
17 | | education program (IEP) that the student may be eligible to |
18 | | receive additional services, benefits, or resources through |
19 | | PUNS or SSI or may benefit from a special-needs trust as a |
20 | | beneficiary. |
21 | | (c) A school district must provide the written notification |
22 | | under subsection (b) no later than 30 days following the |
23 | | implementation of the initial IEP for the student and once a |
